The Scottish Government believes that bullying and harassment of any worker, under any circumstances, is unacceptable. Employment law, Equality law and Health and Safety legislation remains reserved to the UK Government. Only with the devolution of further powers will the Scottish Government have the full set of levers to take real action on workplace injustices.

However, in the absence of such powers, we are using our Fair Work policy to promote fairer work practices across the labour market in Scotland.

In the Scottish public sector, while executive non-departmental public bodies have their own HR policies independent of Scottish Government, we’d expect their policies to align with Scottish Government priorities. All public bodies should have in place appropriate HR policies for their staff, which comply with current employment legislation, other relevant guidance, and the standards expected of public sector employees. These should include but not be limited to: grievance procedure, guide to standards of behaviour, disciplinary procedures, whistleblowing, and performance management for all staff.

The Scottish Government believes that bullying and harassment of any worker, under any circumstances, is unacceptable. We endorse the Fair Work Convention's Fair Work Framework and agree that every worker, regardless of status or position, should be treated fairly and with respect.

The Scottish Government promotes the role of Citizens Advice Scotland and the Advisory, Conciliation and Arbitration Service (ACAS) in providing advice and support on workplace issues, such as bullying and harassment.

We are also committed to supporting strong trade unions in Scotland for the benefit of workers and our economy. It is our belief that a progressive approach to industrial relations and to trade unionism is at the very heart of a fairer, more successful society, and we are clear that trade unions are key social partners in delivering our economic and social aspirations. Trade unions are a mechanism for providing effective voice in workplaces and have a role to play in tackling issues such as workplace bullying.

Scotland is home to several vibrant, growing and dynamic technology sectors, and the Scottish Government recognises their importance to our current and future economy. Our 10-year National Strategy for Economic Transformation seeks to strengthen Scotland’s position in new market opportunities, and specifically cites enabling technologies, like photonics and quantum, that have close links to the semiconductor industry. Our Technology Sector Export Plan will also develop the export capacity and capability of our enabling technologies sectors.

Scotland has considerable photonics expertise, being home to approximately 60 companies, and the only Fraunhofer Research Centre in the UK - the Fraunhofer Centre for Applied Photonics. In December 2021, I announced £6.5m of funding to support the next phase of its applied photonics research and innovation activities. The development of our quantum sector is supported through institutions such as the University of Glasgow’s Quantum Technology Hub, while Technology Scotland have also established a Quantum Special Interest Group. The Group is currently drafting a paper, due to be published this year, setting out quantum technology ambitions for Scotland over the next decade.

The Scottish Government HL1 data collection gathers information relating to reason support may need to be provided, according to the judgement of a homelessness officer, for households who make a homelessness application.

No information is gathered about support needs or disabilities of individuals within the household.

The HL3 data collection gathers information about temporary accommodation placements associated with homelessness applications. The following information has been derived by linking data from Scottish Government HL1 and HL3 collections

Under the Matrimonial Homes (Family Protection) (Scotland) Act 1981 a spouse can ask the court for an exclusion order to remove the other spouse from the matrimonial home. Civil partners have a corresponding right under the Civil Partnership Act 2004. A cohabitant can also seek an exclusion order where the court has granted them occupancy rights.

The court can make an exclusion order if it appears to the court that the making of the order is necessary for the protection of the applicant or any child of the family from any conduct or threatened or reasonably apprehended conduct which is or would be injurious to the physical or mental health of the applicant or child.

These orders are temporary. For example, an order will end if the family home is sold or the couple divorce.

There are other civil remedies available to those at risk of domestic abuse. These include an interdict which can prohibit or restrain specified behaviour. By virtue of the Domestic Abuse (Scotland) Act 2011 a breach of a domestic abuse interdict with a power of arrest attached is a criminal offence. Another potential civil remedy is a non-harassment order under the Protection from Harassment Act 1997, breach of which is again a criminal offence.

The Scottish Law Commission are considering carrying out a review of civil remedies in relation to domestic abuse in phase 2 of its work on aspects of family law .

Social landlords in Scotland must already meet the Scottish Housing Quality Standard which requires properties to be free from damp, have adequate ventilation and be suitably insulated and they must ensure any requests for repairs are carried out in a timely fashion. Compliance is monitored by the Scottish Housing Regulator. If landlords fail to comply, tenants can escalate complaints to the Scottish Public Sector Ombudsman. The latest report on the Scottish Housing Charter shows that almost 9 out of 10 social tenants are satisfied with the homes and service that their landlord provides.

The Regulator is currently working proactively with social housing providers to identify and share best practice in dealing with damp and mould and is expected to publish updated guidance shortly.

The Scottish Government does not hold that specific information. However statistics collected from local authorities includes information on housing for disabled people: Housing for Older People and People with Disabilities and the Scottish Housing Regulator also collects information on numbers of housing units for disabled people: Statistical information | Scottish Housing Regulator .

The Scottish Government is committed to improving the lives of people with complex care needs. Along with the Minister for Mental Wellbeing and Social Care, I recently wrote to all areas to encourage greater collaborative working across integration authorities and local authorities to deliver integrated housing, care and support services for people with complex care needs living in Scotland.

We do not have plans to introduce legislation to establish an Older People’s Commissioner. There are existing commissions that protect the rights of older people. The Scottish Human Rights Commission (SHRC) and the UK Equality and Human Rights Commission (EHRC) already play a role in relation to the rights of older people in respect of age as a protected equality characteristic. In addition, we continue to work closely with the Older People’s Strategic Action Forum on a range of priorities for advancing age equality.

We are committed to promoting the rights of older people and ensuring that they benefit from all that we are doing to improve people’s lives. That is why we provide over £2.2million to support older people's organisations to tackle inequality and discrimination and support our aim to promote the rights of older people.

Reducing health inequalities continues to be a top priority for the Scottish Government, and we recognise that particular efforts are needed for vulnerable populations, such as people who inject drugs. We know that stigma can stop people accessing the support they need and that stigma can manifest in many ways and in many settings. That is why Scottish Government recently facilitated a campaign to challenge the stigma which too often negatively impacts upon those who use drugs. In addition to this campaign, on World Aids Day 2022, the Public Health Minister announced the development of a national awareness raising campaign focused on reducing historical stereotypes associated with a positive HIV diagnosis.

Further to these campaigns, the HIV Transmission Elimination Proposal highlighted that equitable access and uptake of key prevention measures is required to avoid amplifying existing inequalities. Reducing health inequalities will be a key consideration for the HIV transmission elimination implementation group as they assess and prioritise the recommendations contained within the proposal.

The Scottish Government does not hold this information as the recruitment and deployment of all staff in local authority schools is a matter for individual Councils.
