We are disappointed that the UK Government failed to engage with us on this change and are concerned about the additional pressure this decision places on third sector organisations across Scotland. It is not right that these organisations should be disadvantaged by the UK Government’s policy change.

The Scottish Government greatly values the essential role of Scotland’s third sector in working across communities to tackle tough social issues at source. We recognise that the third sector needs stability and the opportunity for longer term planning and development. We are committed to developing a Fairer Funding approach for the third sector, despite the financial restraints we face.

The Scottish Government recognises the vital role of retailers in our society and want to ensure that they are protected. We also recognise the distress caused by retail crime, particularly to staff. The investigation of criminal activity and deployment of resources is a matter for Police Scotland and they remain focused on keeping communities safe from harm, and investigating criminal activity. However, Policing itself also remains a priority for this Government. We are aware that some of the perpetrators of shoplifting offences have links to organised crime.

In our 2025-26 draft budget, the Scottish Government has proposed up to £3 million in funding to be used for the purpose of exploring the implementation of a partnership between the Scottish Government, Police Scotland and Scotland’s retail sector in an effort to combat organised retail crime. This is in line with our Programme for Government (PfG) commitment to address organised crime, which is an area of significant and growing concern to retailers.

The Scottish Government and its partners on the Serious Organised Crime Taskforce are fully committed to tackling serious organised crime in all its guises and reducing the harm it causes to our communities.

The proportion of schools reported as being in good or satisfactory condition has increased to 91.7% (90.9% in 2023). This is 29 percentage points higher than in April 2007 (62.7%).

The proportion of pupils educated in schools in poor or bad condition has decreased from 8.5% of all pupils (around 60,000) last year to 8.0% (around 56,000) this year. This represents a drop from 37.6% of all pupils (around 257,000) in 2007.

Since 2007-08, 1,139 school builds or substantial refurbishment projects have been completed.

The Scottish Government is aware of the business and policing partnership Project Pegasus, currently operating in England and Wales. We are committed to exploring any possible options to tackle organised retail crime in Scotland and are open to exploring the prospect of implementing a similar joint initiative between Police Scotland, the Scottish Government and our valued retail stakeholders in an effort to do all we can to combat the unacceptable rise in organised crime affecting retailers.

To demonstrate this commitment, the Scottish Government’s draft budget for 2025-26 includes up to £3 million in funding to be used for the purpose of exploring the implementation of a similar partnership between the Scottish Government, Police Scotland and Scotland’s retail sector in an effort to combat organised retail crime.

Discussions regarding retail crime have taken place between the Scottish Government and retail stakeholders through the Retail Industry Leadership Group (ILG), Co-Chaired by the Minister for Employment and Investment. Additionally, there has been early engagement between Scottish Government officials and Police Scotland around potentially developing a similar system in Scotland alongside partner organisations. No research has currently been undertaken by Scottish Government officials on this matter but the early findings from Project Pegasus will be of interest in taking forward action in Scotland.

The Scottish Government is actively engaging with the other UK nations to explore opportunities to update and strengthen the current battery recycling regulations. This collaborative approach ensures that any future measures are both effective and consistent across the UK, providing a clear and efficient framework for businesses and consumers alike. We recognise the importance of working together to improve public awareness, enhance recycling infrastructure, and address the environmental risks associated with improper battery disposal.

The current regulatory framework, the UK Waste Batteries and Accumulators Regulations 2009, has been instrumental in establishing recycling systems over the past decade. However, with the increasing use of batteries in consumer electronics and emerging technologies, we are keen to modernise these regulations to better address current challenges and future demands. As part of this, we are considering a range of policies to improve battery recycling rates and reduce environmental harm, including a potential deposit return scheme for batteries and battery-containing products. While such a scheme could bring significant benefits, we recognise the need to address practical and logistical challenges to ensure its feasibility and effectiveness.

Before implementing any new measures, we are currently looking into drafting a consultation with the other UK nations. This will provide an important opportunity for stakeholders, including businesses and the public, to contribute their views and consider the options for improving battery disposal and recycling practices.

We continue to explore a wide range of measures to support sustainable solutions, including encouraging innovation in recycling technologies, enhancing public awareness initiatives to promote responsible recycling behaviour, and working with manufacturers and retailers to improve collection and disposal systems. These efforts are aligned with Scotland’s broader environmental priorities, including the transition to a circular economy and achieving net-zero emissions.

Through collaboration, innovation, and public engagement, the Scottish Government remains dedicated to addressing battery disposal challenges and delivering effective, sustainable solutions for Scotland’s communities and environment.

Through the Peatland ACTION partnership, the NatureScot-led Peatland Skills Action Plan focuses on increasing workforce capacity for design of restoration schemes and growth in the contracting sector to ensure delivery towards our future restoration targets. The current focus is being directed towards supporting ongoing skills development and ensuring the most effective use of the workforce available.

The Scottish Government is committed to delivering clean heat and improved energy efficiency whilst ensuring foremost that tenants are not negatively impacted by the costs of this clean heat transition.

Regulation of consumer protection remains a reserved matter, and Ofgem will be the future regulator of consumer protection for heat networks. In November, the UK Government and Ofgem jointly published a consultation on consumer protection proposals that would require heat networks to meet new consumer standards similar to those that already apply to gas and electricity customers. We welcome these standards as the major step needed to protect consumers, and are working with UK Government to help inform them.

Consumer Scotland will carry out consumer advocacy and advice services for Scottish Heat Network consumers from April 2025 ahead of the implementation of the regulatory framework, anticipated in January 2026.

Registered Social Landlords (RSLs) may also be able to procure fuel for their heat networks, such as natural gas, through public sector utility frameworks, which could result in lower fuel costs for tenants.

The Scottish Government wants the people of Scotland to see maximum benefits from Scotland’s energy transition, including the scaling up of the hydrogen industry.

Social Security Scotland make awards on an on-going basis. This means that awards do not have a set end date after which the client must re-apply. Instead, we conduct light-touch reviews to ensure that the existing award continues to be right for the individual.

In most cases, a review date is set as part of a determination decision to ensure continuous evaluation of a client’s eligibility. Review dates are often set based on when a person’s circumstances are likely to change in the future.

Clients have a duty to notify Social Security Scotland when there is a change in circumstances, including a change in medical condition, which could impact their entitlement. This leads to a review of their existing award and a new decision on their entitlement. In house Health and Social Care practitioners are available to provide advice during the case review process.

For some people, even long review periods are inappropriate, and indefinite awards have been introduced for people who receive Adult Disability Payment or Pension Age Disability Payment whose needs are highly unlikely to change.
