Food Standards Scotland is not responsible for investigating local incidents of foodborne illness which are potentially linked to restaurants and takeaway outlets. Investigations of sporadic cases of gastrointestinal illnesses, including those suspected to have been caused by food, are led by NHS Health Boards with support from the relevant environmental health departments, which have responsibility for taking appropriate action where a particular food business may be implicated. FSS will become involved in the investigation of these incidents when they involve meat processing businesses for which FSS is the enforcing authority, in circumstances where the implicated food has been distributed across a number of Local Authority areas, or when there has been an outbreak of illness (multiple cases of foodborne illness) which has extended nationally or has the potential to result in a serious public health risk. Where a national outbreak is detected a multi-agency response may be convened through an incident management team involving Public Health Scotland (PHS) and NHS Health Boards (which lead the epidemiological investigations), and Local Authorities and FSS (which lead the food chain investigations). In this situation FSS will ensure the traceability of implicated products and support Local Authorities in their enquiries and sampling activities aimed at identifying the source of the outbreak.

The Scottish Government has no functions in relation to the windfall tax. The oil and gas fiscal regime - including the Energy Profits Levy or "windfall tax" - are wholly reserved to the UK Government, as are decisions on how to spend the revenues raised.

As Scottish Government functions have increased and matured, the volume and complexity of outsourced legal work has also evolved. This work is procured and we are now utilising the third iteration of a framework providing Legal Services to the Scottish Government and the wider public sector. As set out in the answer to question S6W-34488, the responsibility of undertaking a full Island communities impact assessment is on local authorities. Additionally, Local authorities have the power to charge different rates and exemptions for different geographical areas. Each local authority has a responsibility to publish assessment of the impacts of introducing a Visitor Levy, and they have a statutory requirement to consult with local communities, businesses, and the public, prior to the introduction of a Visitor Levy.

We formed an Expert Group made up of key representatives from the tourism industry and local government, chaired by Visit Scotland. The Group developed Guidance for local authorities on introducing and administering a visitor levy. Chapter 18 of guidance published October 2024 has further details of what is required of local authorities when implicating a Visitor levy Visitor Levy Guidance I VisitScotland.org.

Affordable housing has a clear priority in this year’s Programme for Government. We are investing nearly £600 million in affordable housing in 2024-2025, which includes the additional £40 million capital for acquisitions and voids announced earlier this year. The 2025-2026 draft budget of £768 million is an increase of over £200 million when compared to the current financial year’s original published budget and reinforces our commitment to delivering affordable housing.

In the year to September 2024, Official Statistics: Housing statistics quarterly update: new housebuilding and affordable housing supply - gov.scot show an 8% decline in new build starts through the Affordable Housing Supply Programme (AHSP) and an 8% decline in all starts through the AHSP. We remain focused on delivering 110,000 affordable homes by 2032, with at least 70% of these for social rent and 10% in rural and island areas, including new build, rehabilitation and acquisitions. We continue to work with partners to increase the delivery of more affordable homes, the majority of which will be for social rent, including supporting acquisitions of existing properties. This includes meeting the existing commitment to the targeted use of £80 million for acquisitions and voids over this and next year.

We have also committed £100 million over the longer term to grow institutional investment to at least £500 million and support the construction of around 2,800 mid-market rent homes.

Since 2007, we have supported the delivery of more than 135,000 affordable homes, over 95,000 of which were for social rent, including 26,000 council homes. Of these, between 23 March 2022 and end of September 2024, we have delivered 24,382 affordable homes towards the 110,000 target, of which over 18,000 have been homes for social rent. We continue to work closely with partners to deliver the right homes in the right places.

The Scottish Government has not sought formal advice on this issue. Regular discussions are held between Scottish Government officials and NatureScot regarding commencing of the muirburn licensing provisions. NatureScot are working towards putting the necessary arrangements in place to allow for commencement of these provisions ahead of the 2025 muirburn season.

The Scottish Government recognises the challenges associated with introducing this complex area of licensing but with the help of stakeholders through the Muirburn Code Working Group we are confident that the provisions can be in place ahead of the 2025 season. NatureScot has prioritised this area of work within its licensing team and online development and design team. Progress is being made in developing an easy-to-use online application form and in providing clear guidance around identifying peatlands.

A final draft of the Muirburn Code was discussed by the Muirburn Code Working Group at their meeting on 26 February 2025. It is expected that the final Muirburn Code will be signed off for publication shortly after this meeting and the Scottish Government and NatureScot aim to make it available by the end of March 2025.

Transport Scotland completed the second Strategic Transport Projects Review which sets-out the Scottish Government’s priorities for future capital investment, including new investment in the trunk road network.

Alongside the design development process of any major transport capital project there is a need to develop the appropriate level business case. These project specific business cases are developed in line with the Guidance on the Development of Business Cases in Transport Scotland, the latest transport scheme assessment and evaluation criteria and the Scottish Public Finance Manual. These cover the 5 Scottish Transport Appraisal Guidance criteria of Economy, Climate Change, Environment, Health, Safety and Wellbeing and Equality and Accessibility as well as any Transport Planning Objectives and the process checks that projects remain in line with the initial assessment on which decisions were made.

I have raised concerns with the UK Treasury about the impact on public services if this reserved tax increase is not fully funded. The Scottish Government has published updated estimates of the impact of the increase in employer national insurance contributions on the public sector in Scotland. These estimates indicate the combined impact on the public sector and commissioned services is over £700 million. If the UK Government’s reported allocation is all that is provided, the Chancellor will be short-changing services the public depend on by over £400 million. The Scottish Council for Voluntary Organisations estimates that the third sector in Scotland will face additional costs of £75 million per year, plus wider inflation.
