As detailed in my letter to NZET Committee on 17 December 2024, the technological and financial landscape has changed significantly since the Decarbonisation Action Plan was first published. The Scottish Government currently faces significant financial and budgetary pressures. As a consequence of these challenges, it is clear that the 2020 Decarbonisation Action Plan commitment to decarbonise rail services by 2035 can no longer be met. A revised target of 2045 is planned for the refreshed Rail Services Decarbonisation Action Plan.

The replacement for ScotRail’s High Speed Trains (HST) is expected to be more energy efficient than the HSTs and therefore will significantly reduce emissions, a direct contribution to decarbonisation.

The Scottish Government welcomes the publication of the interim report of the Independent Review of Adult Disability Payment and thanks the chair, Edel Harris for her work. The Scottish Government is now carefully considering these initial findings, including the areas the Chair considers may be capable of early action.

The assigning of a hearing for trial is an order of the court and is recorded within the court’s interlocutor for each case.

COPFS uses a live, operational database to manage the processing of reports submitted to Procurators Fiscal by the police and other reporting agencies throughout Scotland. It is designed to meet business needs in the processing of criminal cases, rather than for statistical analysis. Scheduled trial data is not retained once a date is cancelled regardless of the reason.

Information in respect of cases brought to court is produced by the Scottish Government, using data provided both by COPFS and SCTS. These are national figures and are not produced for individual courts or Procurator Fiscal Offices.

COPFS uses a live, operational database to manage the processing of reports submitted to Procurators Fiscal by the police and other reporting agencies throughout Scotland. It is designed to meet business needs in the processing of criminal cases, rather than for statistical analysis. Any data sought in the last reporting year would encompass cases reported within that period where there were still significant numbers of live charges. As such, any figures would not accurately reflect numbers of convictions in respect of the cases reported in that period.

As at 1 November 2024, there were 100 homicide cases being investigated, which includes cases which have been indicted and are awaiting trial. This figure does not include the number of cases with ongoing trials as this figure changes on a daily basis.

The ScotRail HSTs fleet is safe, and will continue to remain safe; this has been validated by an independent review of the HSTs’ design and construction, and endorsed by the industry safety regulator, the Office of Rail and Road.

Operational safety is a matter for ScotRail Trains and Network Rail, who are jointly responsible for the management of safety risks on Scotland’s Railway.

The final subsidy for ScotRail for the financial year 2024-25 will be known when the accounts for this year have been finalised and published. Subsidy provided to other train operating companies is a matter for the UK Department for Transport, Transport for London and the Welsh Government.

Low Carbon electricity generation is defined for Scottish Government energy statistics reporting as electricity generated by renewable, nuclear or pumped hydro storage (PHS) technologies.

The Cladding Remediation Programme is accelerating the pace of delivery now that we have put in place the essential building blocks, including the Housing (Cladding Remediation) (Scotland) Act 2024, which will be commenced on 6 January 2025.

As we finalise these acceleration plans, we are diligently working on cost estimates to ensure financial clarity. However, the Scottish Government’s position remains that we will invest as necessary to effectively minimise risks posed by unsafe cladding.

Our spending on remediation costs can only follow a full end to end process - checking buildings are in scope, commissioning a Single Building Assessment, completing that robust technical assessment, identifying the works that need to be carried out, designing those works and gaining the necessary approvals, and then carrying out the remediation itself.

Investment in the programme continues with £52.2 million allocated in the 2025-2026 Scottish Government budget to support delivery and acceleration.
