The Scottish Government accepts the UK Supreme Court judgment in the appeal brought forward by For Women Scotland against Scottish Ministers, which has confirmed the meaning of woman under the Equality Act 2010. As the Equality and Human Rights Commission are the body responsible for regulating and enforcing the mainly reserved Equality Act 2010, we await their updated Code of Practice while we consider our next steps. However, the Scottish Government is also taking action now in preparation for the updated Code of Practice. Our internal Short Life Working Group is assessing implications of the Supreme Court judgment in areas such as legislation, guidance and policies . This work will position us towards a state of readiness to take all necessary steps when the EHRC’s Code of Practice is published.

This year Extended Producer Responsibility for Packaging (pEPR) will commence payments to local authorities to support efficient and effective collection services for household packaging waste. There will be no reduction in the local government finance settlement as a result of extended producer responsibility for packaging payments in the first year of the scheme (2025-26). This additional funding will ensure that local authorities are supported to deliver household collection of packaging waste across Scotland.

The Circular Economy Route map commits Scottish Government to co-design the new Code of Practice to create modern, efficient, and affordable waste and recycling service standards that are deliverable. This includes ensuring the most effective approaches to implementing kerbside collection of plastic film and flexible packaging in Scotland. Individual local authority performance targets and pEPR payments will also help underpin increased collection and aggregation. The Recycling Improvement Fund has already helped two authorities to collect flexible plastic from households across their full authority area (Fife and Perth & Kinross).

The UK Plastic Packaging Tax incentivises the use of recycled plastic by taxing plastic packaging components containing less than 30% recycled plastic. From April 2027 changes to this tax will mean that pre-consumer plastic waste will not count towards this percentage, further acting as a “pull” to increase use of recycled content. The tax has increased from £210.82 per tonne in 2023 to £223.69 per tonne on April 1, 2025.

Since 2011 the Scottish Government has invested over £65 million to develop ChargePlace Scotland (CPS) with the aim of encouraging the uptake of electric vehicles (EV). To grow CPS, Scottish Ministers have provided grant funding to over 400 organisations across the public, private and third sectors to install charge points and make them publicly available on the CPS network. The grantees are the owners of the charge points on CPS and responsible for tariffs, ongoing maintenance and upgrades. CPS’ role as the operator is to make them available to the public so that drivers can easily locate and pay for charging sessions.

As a direct result of this funding and increasing private sector investment Scotland now has over 6,900 public charge points. A target for 6,000 public charge points was met in October 2024, two years ahead of schedule.

In addition to investment in public charge points, Scottish Ministers have also provided over £19 million for the installation of over 23,000 lower powered charge points at homes and at workplaces, complementing the public charging network. Ministers remain committed to supporting drivers in the year ahead, setting aside further funding to support consumer incentive schemes for the installation of EV infrastructure at people’s homes, workplaces and public places.

The Scottish Government will continue to enable increasing private sector investment, whilst targeting public funding towards those parts of Scotland less likely to benefit from standalone private sector investment in public EV charging. This includes the £30 million provided to local authorities through our EV Infrastructure Fund which is on track secure additional private sector investment in public EV charging and support the provision of a further 6,000 public charge points across Scotland.

The Scottish Government is committed to ensuring that all people living in Scotland with long term conditions including Chronic Kidney Disease are able to access the best possible care and support, and benefit from healthcare services that are safe, effective and put people at the centre of their care.

We are running our public consultation on the Long Term Conditions Framework from 23 April to 20 July 2025. This is available at Health: Long Term Conditions Framework - Scottish Government consultations - Citizen Space.

We will take the results of the consultation into account when developing the framework which will include identifying areas where targeted condition-specific action will still be needed.

Detailed requirements were outlined by Scottish Government in DL23 (2024) providing guidance on the development of NHS Board Anti-Racism plans was issued to Health Boards on 9 September 2024. This guidance requires Health Board Anti-racism plans to focus on equity within the guidance to Health Boards and emphasises an anti-racism approach in addressing racialised healthcare inequalities.

The guidance challenges specific priorities, and aims to support aligned local and national actions, to tackle racialised health inequalities. By implementing these strategies and initiatives, the Scottish Government aims to create a more accessible, equitable, and patient-centred healthcare system for all, including Black and Minority Ethnic communities in Scotland.

The treatment and disposal of biodegradable municipal waste (BMW) is the responsibility of those who collect this material – local authorities and private businesses.

However, as part of the Government-commission report published in October 2024 ("Landfill Ban Assurance Study"), commentary was provided on residual waste markets external to Scotland and their "capability to contribute towards managing any capacity deficit in Scotland from 2026".

Officials continue to work with waste sector partners, including local authorities on these matters.

In October 2024, a report commissioned by the Scottish Government projected an initial treatment capacity shortfall for residual waste in Scotland of 600,000 tonnes when the ban on landfilling biodegradable municipal waste commences on 31 December 2025.

However, alongside further measures to reduce waste and promote recycling, the construction of planned infrastructure continues, helping to address this temporary gap; and available projections continue to indicate before turning into an estimated capacity surplus from 2027.

Officials continue to work with waste sector partners, including local authorities on these matters.

The £6,252,000 of new funding we are providing for diabetes technology in 2025-2026 is in addition to the recurring funding we have announced previously.

The decision to offer home dialysis to patients is primarily a matter for NHS Boards. As set out in my answer to S6W-38515 on 17 June 2025, NHS Boards are required to develop plans to address racialised healthcare inequalities.

Last year, we agreed a national policy to reimburse patients for the additional electricity costs of home dialysis so that patients are not exposed to the impact of high energy prices. It also removes the financial disincentive to making a choice for home dialysis over in-centre treatments, allowing personal choice in where and how to receive treatment.

In line with the Labour Party Motion, it is for Scottish Enterprise to decide the scope, timescale, and terms of reference of the review. The Scottish Government has remained in close contact with Scottish Enterprise on this work, exchanging relevant advice and views.

Ministers have no plans to consider business travel under the Air Discount Scheme, as this would be in breach of current State Aid compliance.

Ministers are currently considering the scope and structure of the Air Discount Scheme review, including how the views of stakeholders can best be taken into account.

A key priority for the Scottish Government is to encourage apprenticeship delivery in island and rural communities to support inclusive growth. Through Skills Development Scotland we introduced a rural uplift for Modern Apprenticeship delivery which is an increased payment to training providers to encourage provision in island and rural areas.

Travel and Subsistence (including accommodation) funding is also available to support Apprentices who must attend structured and formal off-the-job training (outwith normal daily travel requirements) where this is required by the Modern Apprenticeship Framework.
