The Scottish Government supports local authorities to meet the statutory duties stemming from Part 9 of the Community Empowerment Act (Scotland) 2015 through a range of guidance and collaborative networks, supporting and strengthening local expertise.

In partnership with the Association for Public Service Excellence (APSE), earlier this year the Scottish Government arranged workshops to provide a high-level overview of the legislative requirements of Part 9 and an opportunity for allotment officers to share best practice and network. As a direct consequence of positive feedback received from these workshops, ongoing networking and mutual support will be facilitated when APSE establish a specific allotment and community growing network in the coming weeks.

The Scottish Government has also published detailed guidance to assist local authorities in fulfilling their Part 9 statutory duties:

While the Scottish Government provides support and guidance, decisions regarding allotment provision ultimately rest with individual local authorities. As per the statutory duties under Part 9, they are expected to take reasonable steps to meet their obligations where specific demand for allotments is met.

The Scottish Government continues to support the development of our ports including the potential for new direct freight and passenger ferry services linking Scotland to Europe.

Within the Scottish Government, the Chief Scientist Office (CSO) is responsible for supporting Health and Care research.

CSO runs a number of project and fellowship funding schemes for Scottish-led research and this role is well known across the Health and Care research community here.

Applications on the potential use of Mifepristone to prevent women at high risk of breast cancer from developing the disease are welcomed. In common with all applications, these would go through CSO's standard independent expert review process to enable funding decisions to be made.

In addition, through UK-wide funding arrangements, the majority of funding programmes administered by the National Institute for Health and Care Research (NIHR) are open to applications led by researchers based in Scotland.

The Scottish Government funds the National Autism Implementation Team (NAIT), which is currently supporting NHS Boards to develop, enhance and redesign existing local adult neurodevelopmental services. We continue scope the work required to improve Adult Neurodevelopmental Pathways nationally, understanding that a stepped care model is needed to reduce waiting times for adult neurodevelopmental assessments and ensure a consistent approach to them across Scotland.

We continue to fund NHS Education for Scotland and NAIT to deliver professional learning on neurodevelopmental conditions. Training is offered at informed, enhanced, specialist, and expert levels, with strong uptake across all tiers.

To ensure there are protections for women and girls in law, we have laid in draft an SSI to add the characteristic of sex to the Hate Crime and Public Order (Scotland) Act 2021. This ensures that women and girls will have the same protections as other groups protected by that Act. If passed, it will make it an offence for a person to stir up hatred against women and girls, and where an offender is motivated by, or demonstrates, malice and ill-will towards women and girls in committing a criminal offence, that offence will be aggravated by prejudice relating to the characteristic of sex.

This SSI is subject to super affirmative process and is therefore subject to consultation prior to the final version being laid in Parliament. Further, we continue to take forward a range of actions in schools to address gender based violence and sexual harassment. Our Mentors in Violence Prevention (MVP) Scotland Programme is working to tackle gender stereotyping and attitudes that condone violence against women and girls, and addresses a range of behaviours including name-calling, sexting, controlling behaviour and harassment. We have also published a national framework for schools to help tackle sexual harassment and gender-based violence. Rape Crisis Scotland also provide a national sexual violence prevention programme to local authority secondary schools across Scotland. The programme aims to provide consistency in approaches to the prevention of sexual violence and contributes to Equally Safe (our strategy to prevent and eradicate violence against women and girls). Since the programme started in 2016, it has reached over 48,000 pupils.

Given the short amount of time left in this Parliamentary session, there is insufficient time for a Misogyny Bill to be finalised and introduced. This is a complex area of policy and law, and it would be necessary that any Bill which brought misogyny into criminal law contained clear and unambiguous provisions in regard to the circumstances in which they apply. This would include the policy implications of the recent Supreme Court judgment.

The Scottish Government recognises that access to social care services can vary significantly depending on where people live.

Through the Care Reform (Scotland) Act and the work of the NCS Advisory Board, we are taking decisive steps to end the postcode lottery and deliver care based on need, not geography.

The Care Reform (Scotland) Act introduces wide-ranging reforms that enshrine rights in law. Key measures include:

• Anne’s Law which recognises family and friends of care home residents as essential contributors to their care—not merely as visitors, but as integral members of the care team
• Introducing a statutory right to breaks for unpaid carers
• Expanding access to independent advocacy
• Improving information sharing across care settings
• Establishing a National Chief Social Work Advisor and National Social Work Agency
• Reforming procurement routes for the third sector

The interim NCS Advisory Board brings together people with lived experience of care, frontline workers, service providers, and representatives from local government and the NHS. Their role is to advise on how we build a fairer, more responsive system that puts human rights and equity at its core.

The Board will work alongside established national programmes to drive improvement and ensure that services are consistent, fair, and high-quality, regardless of where people live in Scotland.

Transport Scotland has had no requests for support from Argyll and Bute Council regarding the closure of the B8035. Transport Scotland has responsibility for the trunk road network, and as such has no responsibility for the maintenance or repair of any local road.

Local authorities have a duty under the Roads (Scotland) Act 1984 to manage and maintain local roads in their area and duties under the Road Traffic Regulation Act 1984 to secure the expeditious, convenient and safe movement of traffic.

Ultimately, it is for locally elected representatives to make local decisions on how best to deliver services to their local communities.
