NHS Dumfries and Galloway have had no Scottish Dental Access Initiative funding awarded in the last two years.

The Strategic Board for Teacher Education has developed a workplan which contains a suite of interdependent workstreams, including workforce planning.

These workstreams contain a range of proposed actions which are in the process of being further developed and which will have individual timescales for reporting to the Board.

The Board last met on 1 February 2024 to discuss the workplan. Papers from this meeting and future meetings will be published on the Scottish Government website in due course.

To date, four out of six key measures provided for within the Fireworks and Pyrotechnic Articles (Scotland) Act 2022 have been implemented, these are:

• A prohibition on providing or making available fireworks or pyrotechnic articles to children;
• A new statutory aggravation for courts sentencing offenders where fireworks were used to attack emergency workers;
• New discretionary powers for local authorities to designate firework control zones; and
• New offences of possession of pyrotechnics in public places and at designated venues and events.

After careful consideration and assessment of the significant financial pressures the Scottish Government is facing following the UK Government’s budget settlement, the Government has decided to extend the timeframe for delivery and implementation of the firework licensing requirement (Part 2 of the Act) to 2026. A pause to the implementation of restrictions to the days of supply and use of fireworks (within Part 3 of the Act), was outlined to the Criminal Justice Committee in March 2023. I am writing to the Convener of the Criminal Justice Committee to provide further details about this decision.

To ask the Scottish Government what the current fire safety regulations are for the development of battery energy storage system (BESS) sites. A range of legislation makes up the regulatory framework for the safety of grid scale battery energy storage systems (BESS). Health and safety is a reserved matter with applicable UK legislation including: the Dangerous Substances and Explosive Atmospheres Regulations 2002; the Electricity at Work Regulations 1989; and the Management of Health and Safety at Work Regulations 1999.

The Health and Safety Executive (HSE) is Britain’s regulator in this regard, and their remit includes health and safety in the workplace as well as public assurance on safety matters.

The Scottish Fire and Rescue Service (SFRS) continue to undertake operational intelligence gathering on such premises and work alongside key partners to ensure that an effective operational response is provided. While clearly this is an operational matter, SFRS will respond to all reports of fire which are received and have the ability to deploy a range of standard and specialist resources as determined by the needs of the incident.

Fire safety measures should be built into such sites during the development that include detection and suppression systems to inhibit the growth and spread of any fire should an incident occur. This is in line with the NFCC Guidance Document .

Simple procedure is a court process designed to provide a speedy, inexpensive and informal way to resolve disputes. A claim is made in the sheriff court with the final decision in a claim made by a sheriff or a summary sheriff. Claimants do not need to use a solicitor to use the simple procedure, but they can do so if they wish.

The following table provides the number of simple procedure claims, and breaks the disposals between those which were successful and unsuccessful. It then gives the average monetary value of the successful claims for each financial year where data is available.

An application was made to Scottish Ministers under section 36 of the Electricity Act 1989 by FlexibleGridPower2 Ltd for the electricity generating station known as Hunterston Grid Services Complex at Campbelton Farm on 17 August 2021.

The Scottish Government was aware from the application that a significant provision of work was planned relating to fire safety at the proposed battery storage facility. This includes a Planning Statement which comments on fire safety at section 2.5.

Paragraph 9 of the decision letter notes from the Planning Statement that “the proposed Development will include safety features including cooling and thermal monitoring with fire detection and suppression equipment. A fire strategy report, fire risk assessment, evacuation strategy, fire safety drawings and a fire safety manual will all be produced prior to construction of the proposed Development.”

As set out in the answer to question S6W-25418 on 22 February 2024, there is no legal requirement for fire safety documentation to be included with applications made under these regulations. Therefore, these were not presented to the Scottish Government prior to Scottish Ministers’ direction that planning permission was deemed to be granted.

In determining the application in question, Condition 6 was applied to the section 36 consent, requiring the development to be undertaken in accordance with the application. This includes the provision of work that was planned relating to fire safety. Once granted, the enforcement and monitoring of the planning permission for Hunterston Grid Services Complex became the responsibility of North Ayrshire Council, the planning authority.

There is no legal requirement for fire safety documentation to be included with applications made under these regulations.

Applicants are not required to submit any supporting fire safety documentation when seeking consent for a development. This is because fire precautions and matters relating to health and safety are not relevant to planning, as they are covered by other legislation.

Matters relating to fire risk are regulated by the Health and Safety Executive, Britain’s Health and Safety regulator. Their remit includes health and safety in the workplace as well as public assurance on safety matters. Health and Safety is a reserved matter, with applicable UK legislation including the Dangerous Substances and Explosive Atmospheres Regulations 2002, the Electricity at Work Regulations 1989, and the Management of Health and Safety at Work Regulations 1999. HSE considers there to be a robust regulatory regime covering the fire risks associated with battery energy storage systems.

As a matter of routine, the Scottish Government will consult the Scottish Fire and Rescue Service and Health and Safety Executive on any new battery storage applications received and take into account any responses received.

The review has now reported its findings, recommendations, and proposed actions. I am carefully considering these, particularly in the context of the Scottish budget set out on 19 December, ahead of publication in the coming weeks.
