As set out in the responses to S6W-28715 and S6W-28717 on 6 August 2024, the Scottish Government has consulted on a range of proposals for aspects of Climate Compatibility Checkpoint design and application and will publish a finalised Energy Strategy and Just Transition Plan, including further information on these matters, later this Summer.

The proposals consulted on in the draft Strategy include significant differences from the Checkpoint approach introduced in 2022 by the previous UK Government, including in terms of how the climate impact of emissions arising from consumption of oil and gas products should be considered and at which stages of the licensing process such Checkpoints should be applied.

The Scottish Government’s focus continues to be on meeting Scotland’s energy security needs, reducing emissions in line with Paris Agreement goals and ensuring a just transition for our oil and gas workforce as North Sea resources decline.

We have, through our draft Energy Strategy and Just Transition Plan, called for a robust Climate Compatibility Checkpoint to be applied to licence applications for new North Sea oil and gas developments. The draft set out for consultation a range of proposals on aspects of Checkpoint design and application, including in relation to alignment with Paris Agreement goals Independent analysis commissioned by the Scottish Government in support of the draft Strategy also included consideration of what tests could potentially make up such a Checkpoint which could form the basis for UK wide and international discussion on this issue, despite the Scottish Government having no formal role in the licencing of new offshore oil and gas fields.

The Scottish Government would be a willing partner in collaborative efforts, at UK and international levels, to further develop the detail of how robust and transparent Climate Compatibility Checkpoints could help support licensing decisions, despite the Scottish Government having no formal decision making powers in this area.

As part of this approach, our finalised Energy Strategy and Just Transition Plan will set out the Scottish Government’s views on key elements which could form the basis of an enhanced Climate Compatibility Checkpoint that could be used by the UK Government, and form the basis of international discussions on this issue.

Urban areas typically have the highest concentrations of roads and as a result any significant road water run-off into rivers usually occurs in these areas. A mix of oils, chemicals and tyre particles from vehicles builds up on urban roads during dry spells and is washed off into drainage systems and watercourses during rainfall events. The resulting runoff can have an impact on our water environment if it enters watercourses before going through any mitigating treatment processes. For example sediment traps, such as road gulleys, or sustainable urban drainage systems designed to filter out as many “first-flush” pollutants as possible.

The widespread, diffuse and sporadic nature of this issue means it has the potential to impact our water environment in a range of ways and makes it challenging to monitor and to address.

The Scottish Environment Protection Agency (SEPA) assess the aquatic environment in Scotland through the Water Framework Directive classification. SEPA carries out a range of surveillance, operational and investigative monitoring to assess Scotland’s water bodies and to prioritise and drive improvements and action where needed. SEPA has assessed two water bodies (sections of rivers) as having failed to have met the water quality standards, where the reason has been ascribed to road transport.

The Scottish Government recognises the importance of managing urban run-off to protect the water environment and to reduce flooding in our towns and cities. The Scottish Government is working to improve how we manage surface water and drainage, including how we can bring in more sustainable urban drainage systems (SUDS) and blue and green infrastructure into our urban environment to help manage pollution and flooding from urban run-off and reduce pressure on piped urban drainage systems. This is part of our developing policy for the future of the water industry in Scotland in response to the climate emergency. We are also currently consulting on Scotland’s first Flood Resilience Strategy which will focus on actions needed to make our communities more flood resilient over the coming decades. Part of this is looking at how we can make the most of urban green spaces and natural water bodies to capture rainwater where it falls and to reduce run-off and water flowing into our drainage systems. This too will help to reduce the impacts of road run-off on the water environment.

The investigation of reports relating to dangerous beauty products, such as counterfeit prescription only medicines (POMs) e.g. unlicensed botulinum toxins, is reserved to the UK Government.

The Medicines and Healthcare Products Regulatory Agency (MHRA) is responsible for compliance with the regulatory requirements which govern the manufacture, distribution, retail sale/supply and advertisement of medicinal products, and the Scottish Government continues to work with and raise concerns to MHRA on these issues.

Other forms of potentially dangerous beauty products, that are not classified as medicinal products (e.g. non UKCA or CE marked dermal fillers), are not subject to the same laws. These should be reported to Local Authority Trading Standards (LATS), as they are responsible for investigating allegations of all forms of dangerous products.

The amount spent by NHS Boards on Family Health Services (FHS), which includes the four primary care contractors, is reported in the annual Cost Book published by Public Health Scotland. The Scottish Government package of support for Scottish domiciled student nurses, midwives and paramedics remains the highest level of support offered in the UK.

The Scottish Government is committed to ensuring that we are able to manage more of our own waste within Scotland both for environmental and economic aims. As part of this, Scottish Government officials and Defra continue to engage regularly on matters regarding international waste exports, a reserved policy area. We are currently seeking confirmation from the new UK Government on its priorities for waste exports policy and continue to encourage Defra to build on work already undertaken to ban the export of plastic waste to non-OECD-countries, and will work closely with them on the development of this.

Through our Circular Economy and Waste Route Map consultation, we are actively progressing actions that we can take under devolved powers to boost Scotland's ability domestically to manage its waste and provide greater incentives for domestic reprocessing. This includes new co-designed recycling standards and consulting on a statutory duty on local authorities and others to report on the final destinations of collected material to increase transparency and strengthen public confidence in recycling services. We have also committed to publish a report on Scotland’s existing and planned domestic reprocessing infrastructure. This builds upon existing measures like extended producer responsibility schemes, and the £63 million-worth of investments made via the Recycling Improvement Fund to improve the quality and quantity of recycling collected.

My deepest thoughts and condolences are with those families affected by a death in prison custody. The Scottish Prison Service (SPS) cares for and supports some of the most complex and vulnerable individuals in our society, often at times of personal crisis.

Ligature prevention is an operational matter and ongoing priority for the SPS. The SPS Estates team consider ligature prevention in the design of cells, which continues to evolve, in order to minimise ligature points.

Following every death in prison, the SPS undertake a Death in Prison Learning Audit and Review to learn from the incident. Any learning in relation to ligature points is reported to the National Suicide Prevention Group, a multi-disciplinary group, which consider the high-level policy implications of tackling ligature risks and agree on any changes to be implemented.

There are ‘safer cells’ throughout the prison estate, which are specifically designed to reduce, as far as possible, opportunities for individuals to cause injury to themselves. Anti-ligature clothing and bedding is available where it is considered appropriate. Safer cells are used as a short term measure when the SPS believes they are necessary to safeguard the health and wellbeing of someone in their care.

Designing a prison that is considered to be entirely ligature point free would create a sterile living environment, incompatible with the aspiration of the provision of a normalised space for those in the care of the SPS. Placing individuals in the care of the SPS in restrictive, depersonalised environments as a matter of course could negatively impact on mental health, as well as indicating a lack of trust or acknowledgement of their needs.
