Since my appointment as Minister for Transport, I have visited Edinburgh Airport and met officials on one occasion in person with a further meeting held virtually. I have met virtually the CEO of AGS Airports, who own both Aberdeen and Glasgow Airports, for a meeting. I have visited Glasgow Airport on two occasions when flying for Ministerial engagements. I have not visited Aberdeen Airport during my time as Minister for Transport. I have not visited Prestwick Airport as Prestwick is not within my Ministerial portfolio.

I am advised that Clause 14.2 of the regulated Track Access Contracts which govern such arrangements between train operating companies and Network Rail require such information to be held confidential during and after the continuance of the contracts.

The regulation of such contracts is the responsibility of the Office of Rail and Road, acting within the UK Government’s railway legislation.

Scottish Government officials have had regular engagement on progress throughout the implementation of the Safe Deposits Scotland (SDS) system upgrade and were made aware of some teething issues with system functions. SDS has since confirmed all priority bugs are now resolved and user journeys should be back to normal.

The role of the Scottish Government, since the three approved schemes began operating in July 2012, is to monitor each scheme for compliance with the Tenancy Deposit Schemes (Scotland) Regulations 2011 . This includes being satisfied that SDS and the other tenancy deposit schemes have clear and substantial processes in place that meet the requirements laid out in the regulations. As part of this monitoring, SDS quarterly performance reports were analysed and measured against the key performance indicators to ensure these were adhered to.

Officials will continue to liaise with SDS on the operation of their new system.

Safeguarding the Eskdalemuir Seismic Array is the responsibility of the Ministry of Defence and any decision to amend the seismic noise budget for the array is a decision for the UK Government.

The Scottish Government and Ministry of Defence have been working constructively together and the Scottish Government has conducted a series of technical studies over the course of 2020 to 2022 in order to provide updated wind turbine data that can be used in the noise budget allocation calculation.

The results of these studies are publicly available and are hosted on the Scottish Renewables’ website. The Scottish Government shared these studies with the MoD and we understand the MoD is in the process of reviewing their noise budget management. The Scottish Government continues to engage with the MoD as they develop their approach.

The public consultation analysis of the responses to the draft route map to achieving a 20% reduction in car km in Scotland by 2030 will be published alongside the final version of the route map in the coming months.

The Scottish Government are committed to working with COSLA, ADES and our partners to deliver improvements in additional support for learning implementation and to ensure meaningful change for children and young people through our Additional Support for Learning Action Plan. The most recent ASL Action Plan progress report published in November 2022 confirms the progress made on the development of the measurement framework, including measures to celebrate the successes and achievements of children and young people with additional support needs. Since the publication of the progress report, a draft of the framework has been considered by the ASL Network and ASL Project Board and officials continue to work with partners to further enhance the framework.

The Scottish Government will continue to report on the progress of implementation of the ASL Action Plan through formal progress reports. The next progress report is due to be published in May 2024.

The Crown does not grant immunity from prosecution but makes prosecutorial decisions based on criteria set out in the Scottish Prosecution Code. Decisions on prosecution are taken independently and are matters for professional prosecutors within the system for which the Lord Advocate and Solicitor General are responsible. It is therefore not appropriate for any other minister, or for Scottish Government officials or special advisers to be consulted in relation to any prosecutorial decisions.

I have confirmed to Mr Marshall’s family that some aspects of the investigation fell short of what they were entitled to expect. The previous decision not to prosecute individual prison officers cannot be reversed. I have instructed Police Scotland to investigate possible corporate responsibility by the Scottish Prison Service.

The way in which custody death cases are handled by COPFS has been reviewed and transformed. I am confident that new structures and processes in place will ensure such cases are undertaken rigorously, respectfully and compassionately.

The Scottish Government’s Chief Scientist Office operates open competitive funding schemes for applied health research projects and fellowships across the wide range of NHS and health challenges in Scotland. These schemes are open to consideration of applications addressing research directed into Cancer. Applications to these schemes are assessed through independent expert peer-review with funding recommendations made by independent expert committees.
