To ask the Scottish Government, in light of its proposed Adults with Incapacity Bill as outlined in its Programme for Government 2024-25, whether it plans to consult on each of the recommendations contained under Recommendation 13.3 of the final report of the Mental Health Law Review, which relate to amending the power of attorney scheme.
Answer
‘The Adults with Incapacity Amendment Act Consultation’ published on 25 July 2024 consults on four out of seven power of attorney (PoA) recommendations at section 13.3 of the Scottish Mental Health Law Review. Although not part of this consultation, the remaining PoA recommendations will be considered as part of the longer term reform programme.

To ask the Scottish Government what action it is taking to ensure that local authorities maintain school buildings to an extremely high standard.
Answer
Although it is the statutory responsibility of all local authorities to manage and maintain the school estate, the Scottish Government is providing them with significant funding towards improving their school estate.
The £2 billion Learning Estate Investment Programme is being delivered in partnership with local authorities and will benefit tens of thousands of pupils across Scotland. It follows on from the successful £1.8 billion Scotland’s Schools for the Future Programme which completed in 2021 and delivered 117 new or refurbished schools.
Our latest school estate statistics, published on 10th September 2024, show that the proportion of schools in “good” or “satisfactory” condition has increased from 62.7% in April 2007 to 91.7 % in April 2024. Investment through the Learning Estate Investment Programme will build on this remarkable progress.

To ask the Scottish Government whether each of its Fisheries Management Plans will be delivered before the deadline.
Answer
At the Rural Affairs and Islands Committee on 11 September, I updated members on the challenges of the current timeframes for all four UK nations in relation to developing quality, credible Fisheries Management Plans and confirmed that I will be writing to the Committee formally in due course regarding the statutory deadlines associated with the plans. I expect to do this shortly and will be happy to update the member further following this communication.
It is important to remember that we already have a strong suite of measures in place to manage our fisheries and safeguard our fish stocks.

To ask the Scottish Government, further to the answer to question S6W-29267 by Fiona Hyslop on 5 September 2024, for what reason it is allocating a third vessel to the Sound of Harris and Sound of Barra routes as part of phase 2 of the Small Vessel Replacement Programme, as opposed to allocating it to an alternative route.
Answer
The Small Vessels Replacement Programme (SVRP) Phase 2 will primarily focus on the Berneray–Leverburgh and Barra–Eriskay routes with a vessel on each of these routes. The third vessel’s deployment is still to be confirmed and is subject to fleet cascades following the successful deployment of the planned 7 new vessels of SVRP Phase 1.

To ask the Scottish Government how many chief executives of non-departmental public bodies have received a non-consolidated performance payment and a pay increase in the same year since 2021, and what the total amount was of any such payments.
Answer
Non-consolidated performance payments for chief executives continue to be suspended. There is a presumption against provision for non-consolidated performance payments in all new Chief Executive contracts or following a review. There are 71 public bodies covered by the Public Sector Pay Policy, and of these there are a small number of public bodies with specific exemptions agreed by Ministers. These are Scottish Water and the Scottish National Investment Bank. All aspects of chief executive pay are detailed within the annual accounts of each public body.

To ask the Scottish Government whether any senior civil servants have received a non-consolidated performance payment without a pay increase in the same year since 2023, and what the total amount was of any such payments.
Answer
In line with Scottish Public Sector Pay Policy, the Scottish Government does not pay non-consolidated performance payments to any staff, including Senior Civil Servants. Therefore, I can confirm that no Scottish Government Senior Civil Servants have received a non-consolidated performance payment in the period referenced.

To ask the Scottish Government whether it will provide full details in relation to the commissioning of Seafish to assist in the delivery of its Fisheries Management Plans under the Joint Fisheries Statement.
Answer
Seafish have supported Defra to deliver Fisheries Management Plans (FMPs) for English waters. We have also utilised their expertise in Scotland by asking them to support the development of the two Nephrops FMPs.
Seafish have been asked to support evidence gathering, collaborative development through sector-specific working groups, as well as delivery of engagement events and workshops.
Seafish have a wealth of experience and knowledge, and have been well placed to carry out stakeholder engagement in relation to Nephrops, and to produce drafts of the FMPs.
