The Scottish Government collects data relating to individual temporary accommodation placements (associated with homelessness applications) through the HL3 data collection. This includes information on whether or not placements have been in breach of the Unsuitable Accommodation Order (UAO).

Comprehensive HL3 data is available for all local authorities from 1 April 2017. The most recent data available is up to 30 September 2021.

Prior to 5 May 2020, a breach occurred when a household with a pregnant women and/or child was in unsuitable temporary accommodation for more than 7 days. From 5 May 2020, this was extended to all homeless households. Therefore, breaches data pre and post 5 May 2020 are not directly comparable.

Various temporary exceptions were introduced from May to September 2020 to allow local authorities to provide households with accommodation in response to COVID-19. These exceptions were still in place by September 2021. Where an exception applied, a breach did not have to be recorded.

As a result of uncertainty caused by the extension of the legislation falling at the same time as the introduction of the exceptions, there was increased scrutiny of the data. This uncovered inconsistency in the practice of reporting and recording breaches across local authorities, including prior to May 2020. Therefore, data on the number of breaches should be treated with caution.

Following identification of this inconsistent recording practice, the Scottish Government issued clarification to local authorities in January 2022. Clearer, more explicit HL3 guidance with worked examples is also being prepared to minimise different interpretations of the legislation and ensure consistent reporting.

The tables below provide the number of UAO breaches recorded in the HL3 return by local authority and by month from 1 April 2017, when comprehensive coverage began, to 30 September 2021.

Figures have been rounded to the nearest five for disclosure control purposes, with the except i on of zeroes – which are denoted by ‘.’ – and values of 1, 2 and 3 - which are denoted by ‘<4’.

The sum of the monthly totals may not match published quarterly figures due to rounding.

Only local authorities with at least one breach from April 2017 to September 2021 are included in the tables. If a local authority is not included, this is because they have no reported breaches over this period.

Number of temporary accommodation placements that have been in breach of the Unsuitable Accommodation Order, by local authority

The Scottish Government is providing the £150 Cost of Living award to every household in receipt of a reduction under the Council Tax Reduction (CTR) scheme, across council tax bands A to H; and to all households in council tax bands A to D who are not receiving a reduction under the CTR scheme. These criteria mean that 73% of all households in Scotland will receive financial support through a reduction in their council tax bill, or as a direct payment. Local authorities are also being provided with funds from which to make Cost of Living award payments to the estimated 38,000 low income households which are exempt from council tax, including those accessing housing support services of living in temporary accommodation. In addition the CTR scheme is there to ensure nobody has to pay a council tax bill they cannot be expected to afford, and reduces a household's council tax liability based on an assessment of their income, capital, and circumstances. Currently over 450,000 households receive some level of CTR, and on average recipients save over £750 a year.

The High Level Group on Planning Performance aims to improve the performance of the planning system for all types of development. The resourcing and performance of the planning system remain key priorities, and new planning application fee levels came into effect on 1 April 2022 which will increase the financial resources available to planning authorities.

Performance is not the sole responsibility of planning authorities: all parties, including applicants, have a role to play in ensuring that applications are determined efficiently and effectively. Accordingly, extending the membership of the High Level Group to include applicants has been considered on a number of occasions. It is important to recognise that the planning system is used by a wide range of applicants across a variety of sectors, so to include all industry and business representative bodies would be unmanageable. However, given the importance of performance, active consideration is being given to how the views and concerns of applicants can be more directly fed into the High Level Group. This will be investigated during the summer and we will be making contact with industry representatives shortly to discuss possible options.

The Scottish Government has no plans to introduce a moratorium on windfarm development.

To achieve a net zero, nature-positive Scotland, our planning system must be rebalanced so that climate change and nature recovery are the primary guiding principles for all our plans and all our decisions. Draft National Planning Framework 4 (NPF4) set out new Universal Policies that should apply to all planning decisions to help us tackle the climate and nature crises and ensure Scotland adapts to thrive within the planet’s sustainable limits. It also included green energy policies which support renewable energy development other than in National Parks and National Scenic Areas, subject to an assessment of their impacts on a case by case basis.

The Parliamentary scrutiny period and public consultation on Draft National Planning Framework 4 has now concluded. Responses received are now being analysed and will inform the finalised NPF4, which will be submitted for Parliament’s approval, prior to adoption by Scottish Ministers.

Draft National Planning Framework 4 (NPF4) set out a spatial strategy based on how our approach to planning and development can help to achieve a net zero, sustainable Scotland by 2045. This included a new policy on community wealth building, supporting a more people-centred approach to economic development. This draft policy proposed that individual proposals in national and major categories of development should contribute to community wealth building objectives.

The Scottish Government also encourages renewable energy businesses and communities to utilise its Good Practice Principles for Community Benefits from Onshore Renewable Energy Developments (and Shared Ownership of Onshore Renewable Energy Developments) (May 2019) which sets out national standards for implementing community benefits.

Due to an unexpected system error 19,881 Scottish Child Payment clients and 1,284 Child Disability Payment clients who were due to receive their regular payment throughout week commencing Monday 18 April experienced a delay of one working day. Social Security Scotland contacted those impacted to let them know in advance. For clarity, they have received all of their payments.

Implementing our improved social security system and work to continually improve this - for example further uprating benefits to help tackle the cost of living crisis - is not without its technical challenges. There are processes in place to mitigate risk and when issues do arise our priority is ensuring people get the money they are due as quickly as possible and protecting those who are the most vulnerable. The unexpected cause of this delay has been identified and rectified.

The Scottish Government has provided £1.4 million to the Scottish Refugee Council for the expansion of its Refugee Integration Service including qualified helpline advisers and caseworkers. People arriving from Ukraine will also be able to access help and support on an ongoing basis from local authority resettlement officers, and they will be able to raise accommodation concerns directly to their housing association or local authority provider.

Criteria for assessing proposals were also set out, including impacts on communities and individual dwellings.

In order to support older and disabled people in meeting this new legislation, we have provided a total of £1.1 million in 2021-22 to Care and Repair Scotland.

We also provided £1 million to SFRS for their Home Fire Safety visits to help those most vulnerable to the risk of fire to meet the new standard. The general principle is that owners are responsible for the cost of looking after private property. Our targeted funding is reaching those most at risk and least able to do the work themselves. There are no currently plans to provide further funding.

The Scottish Government published a statement in partnership with COSLA on 21 January 2022 confirming that local authorities will take a proportionate and measured approach to compliance and individual circumstances will be taken into account.

Whilst we encourage homeowners to install these alarms at their earliest opportunity to protect lives and possessions, we have emphasised consistently that there will be no penalties for non-compliance.
