The Scottish Government remains strongly opposed to the Strikes (Minimum Service Levels) Act 2023 and any associated secondary legislation which affects devolved services. This legislation seeks to undermine legitimate trade union activity and does not respect the Scottish Government’s Fair Work principles. We should be working with trade unions to reach fair and reasonable settlements respecting the legitimate interest of workers, not seeking to curb their right to strike.

Under the Strikes (Minimum Service Levels) Act it is a matter for individual employers in the affected sectors to decide whether to issue work notices to trade unions specifying the workforce required to meet minimum service levels for a particular strike period. We have no intention of directing any employers within their control to issue work notices and will do all we can to oppose this appalling piece of anti-worker and anti-trade union legislation, which will undermine not enhance industrial relations.

The data protection legislation; UKGDPR and DPA 2018 are derivatives of the Human Rights Act. Their purpose is to uphold the rights of individuals in relation to their data and privacy.

The Scottish Government’s aim is to support high quality, relevant, appropriate and accessible ESOL provision that meets learner need. The Scottish Government’s ESOL funding is currently provided through colleges as part of the grant allocated to the Scottish Funding Council. Colleges are instructed to work with Community Planning Partnerships (CPPs) to determine the level of need for provision and agree with partners how this need can be met.

In addition to this, I have announced an independent review of Community Learning and Development (CLD) which includes ESOL learning. The Independent Review of CLD offers a timely opportunity to better understand how we can ensure that proposed changes to the education and skills system has a focus on the most marginalised learners. Given the ongoing work to reform the education sector, and the intention of the review to provide recommendations on how CLD, including ESOL learning, can best fit within it, it makes sense to pause implementation of the adult learning strategy until such time as the future shape and strategic orientation of CLD is considered.

We routinely speak to the Scottish footballing authorities on wide a range of topics, including the behaviour of fans. It should be noted that the majority of supporters across the country go to football to support their team in a safe and responsible manner and that incidents, such as booing during commemorative events, are the actions of a minority. Nevertheless we condemn such actions.

As this match falls under the auspices of the Scottish Professional Football League, it is for them to investigate any incidents and take any appropriate actions against the clubs. Any individuals identified as engaging in criminal behaviour during these investigations will be reported to the police. We have not spoken to either Celtic FC, the Scottish FA or the SPFL about this specific incident.

Clubs are taking action when they can and we welcome the decision by Celtic to ban sections of their fans who, despite numerous requests by the club, continued to demonstrate anti-social behaviour. We would support other clubs in taking similar actions where appropriate.

One of the ways in which irretrievable breakdown of a marriage is taken to be established in divorce actions is if since the date of the marriage the defender has behaved in such a way that the pursuer cannot reasonably be expected to cohabit with the defender. This can include sexual infidelity, both same sex and mixed sex.

Another way in which irretrievable breakdown can be established is if since the date of the marriage, the defender has committed adultery. The Scottish Government’s understanding is that adultery is defined in common law as meaning heterosexual sexual intercourse outside of marriage.

Issues on adultery in divorce law were considered when what became the Marriage and Civil Partnership (Scotland) Act 2014 was being prepared. As the last bullet point of paragraph 138 of the Policy Memorandum for the Bill which became the 2014 Act notes, it appears that for a small number of spouses it may be important to have the civil court find that the other spouse was adulterous.

The consultation planned for 2024 will, in relation to divorce and dissolution, cover court procedures rather than the grounds of divorce and dissolution.

The Scottish Government continues to consider all avenues for securing a sustainable future for Ferguson Marine, including learning from relevant international examples.

The Scottish Government is committed to ensuring that everyone in Scotland whose first language is not English can contribute to Scotland’s future and the society they live in. Having support to learn English is key for many refugees and people seeking asylum, enabling them to participate in learning in schools, colleges and universities; engage within communities; and pursue their employment goals.

Through consultation on the future of adult learning between September 2019 and February 2020, the Scottish Government engaged with over 700 ESOL learners and committed to undertake a review of the impact of ‘Welcoming Our Learners: Scotland’s ESOL Strategy 2015-2020’ to produce recommendations on next steps for these specialisms within the context of the adult learning strategy.

Scottish Ministers have advised the Operators of both the Northern Isles and Clyde & Hebrides Ferry Service contracts that bookings can be opened beyond the end of March 2024. Operators are now working to open bookings as quickly as possible.

On 24 November 2023, the First Minister represented the Scottish Government at the Summit meeting of the British-Irish Council hosted by the Government of Ireland and chaired by the Taoiseach – Leo Varadkar. The meeting was attended by Ministers from six of the eight BIC Member Administrations with Northern Ireland represented by senior officials.

The theme of the Summit focussed on Transforming Children’s Lives: Tackling Child Poverty and Improving Wellbeing. This discussion offered the opportunity to understand the challenges being faced by all of the Governments across these islands and to share and learn from the range of initiatives being taken to tackle the issue.

On the Latest Political Developments item, Ministers took the opportunity to recognise the 25th anniversary of the Belfast/Good Friday agreement and to reflect on the importance of BIC as one of the institutions established under that agreement.

The Council discussed political developments in Northern Ireland and highlighted the importance of the restoration of enduring devolved power-sharing institutions as soon as possible. It also reflected on the situation in Israel and Gaza, the conflict in Ukraine, the Cost of Living Crisis and the forthcoming COP 28.

In the margins of the summit, the First Minister took the opportunity to hold bilateral meetings with the Taoiseach, the First Minister of Wales and the Secretary of State for Levelling Up, Housing and Communities.
