A decision has been made by the Environment Agency to replace some of the Quality Protocols (QP) which only apply in England and Wales, including the QP for Tyre Derived Rubber Materials, with a ‘Resource Framework’. The outcomes of the review of the Tyre Derived Rubber Material QP (published in 2009) are yet to be published therefore we do not know to what extent the Resource Framework will mirror or amend the approach currently set out in the QP.

In Scotland, the Scottish Environment Protection Agency's (SEPA) approach to end-of-waste is similar to the QPs. SEPA has equivalent end-of-waste positions for many of the materials covered by QPs, including compost, anaerobic digestate and aggregates. They do not currently have a published end-of-waste position for Tyre Derived Rubber Materials but have discussed the possibility with tyre recyclers in the past.

The Environment Agency is currently working with representatives from the tyre recycling industry on the design and contents of the new Resource Framework and SEPA will consider the Framework’s findings, once it is understood what the Framework for this material contains. While awaiting the outcome of the QP review, SEPA remains open to approaches from any business seeking to agree an end-of-waste position.

SEPA’s end-of-waste positions take the approach that the storage of recovered materials remains a regulated waste activity until they are dispatched to their end user. This is to ensure that the recovery of the material is genuine and that the material is not just stockpiled with no actual prospect of an end use.

I have asked Teresa Medhurst, Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

The needs and welfare of all those who live and work in our prisons remains a key priority for SPS, as we continue to manage our highly complex population with a person-centred approach.

Supported centrally by SPS Headquarters, establishments have specific arrangements in place to manage their regime during periods of a high prison population. These arrangements include additional staff on shift to support both operations and residential areas and the application of local staff shortage protocols if there are insufficient staff to run a full regime safely.

The new national service will ensure that an offer of support is available to all eligible individuals who are serving a short sentence (under 4 years), or being held on a period of remand.

As with the current Shine and New Routes Public Social Partnership services, the new service will be voluntary, and individuals will have a choice about whether they wish to sign up to the service.

Dedicated prison-based workers will provide initial support during the custodial environment and will contribute to effective multi-agency pre-release planning. Prior to liberation, individuals will be introduced to their community worker who will provide support on release.

SPS will publish information on the releases under the changes to sentencing for short-term prisoners on their website and SPS has previously published information on releases under the emergency release legislation also on their website.

SPS continue to be as open and transparent as possible, whilst continuing to meet their statutory obligation to ensure that those in their care have their personal information protected; as such SPS cannot publish a breakdown of establishments as some of the data could relate to a small group of individuals, which may lead to their inadvertent identification.

SPS are unable to publish the full breakdown of costs as disclosure would be commercially prejudicial to the management of the contract, and to the contractor.

SPS can confirm that the contract contains liquidated damages for any delays.

Any form of violence is unacceptable and will not be tolerated. Schools should be safe and consistent learning environments for all.

Since May 2023, we have responded to teachers’ concerns about relationships and behaviour in a number of ways. This includes the publication of new guidance on gender-based violence, updating our guidance on mobile phones and anti-bullying, and providing £900k to local authorities to support training of support staff.

In August 2024, we published a joint relationships and behaviour in schools action plan with COSLA. The action plan sets out 20 actions to be taken by 2027 at both national and local level to help support schools to improve relationships and behaviour. This includes guidance on the use of consequences in schools and updating our national guidance on exclusions.

In addition, in 2025-26 we are providing:

• A further £29 million of additional investment to local authorities for additional support needs.
• £130 million Pupil Equity Funding to schools.
• £186.5 million to local authorities to restore overall teacher numbers across the country to 2023 level, and maximise the number of teaching posts available.

Finally, through implementation of the Violence Prevention Framework for Scotland, we have invested over £4m in the last two years to help prevent and reduce violence across Scotland. Over 2024-25, £2m of this investment has been used to support delivery of prevention activity including action focussed specially towards young people in collaboration with a range of partners.
