The Crown Office and Procurator Fiscal Service is responsible for issuing Victim Notification Scheme packs. They have advised that the number of packs issued over the last 3 years is:

The most recent reconviction rates show that 29% of people with a Community Payback Order (CPO) imposed in 2017-18 were reconvicted within a year, which is the lowest rate since they were introduced. These statistics are not typically broken down in regard to different requirements within CPOs such as unpaid work or supervision. However, Justice Analytical Services published ‘Community Payback Orders: What the Unit Level Data Tells Us So Far’ in February 2020 which found that the reconviction rate for those given unpaid work between 2012-13 and 2014-15 was 33% where this was accompanied by justice social work supervision, and 27% where it was not. These figures compare with 41% for those given orders with no unpaid work. While no conclusions can be drawn about the impact of unpaid work on offending behaviour, this may suggest that individuals who do not have unpaid work imposed are likely to have more complex and entrenched issues to address and may have greater likelihood of reoffending.

Overall, CPOs are an important aspect of a sustained focus on prevention and effective community interventions which has helped see Scotland’s reconviction rate fall to its lowest level since comparable records began more than 20 years ago.

CPOs offer opportunities for rehabilitation by requiring individuals to tackle the underlying causes of their offending behaviour. They also deliver real benefits to communities, and while capacity to deliver unpaid work has been significantly impacted by the coronavirus pandemic, around 9 million hours of unpaid work have been carried out since CPOs were introduced.

The Victims Taskforce was established in December 2018 to co-ordinate and drive action to improve the experience of victims and witnesses in the criminal justice system - it is not in the Taskforce’s remit to recommend legislative change.

A number of legislative changes have been progressed by the Scottish Government since the inception of the Taskforce that advance or facilitate actions in the Taskforce’s work plan and provide a legislative framework within which further improvements can be made. Examples of primary legislation include the Vulnerable Witnesses (Criminal Evidence) (Scotland) Act 2019, the Forensic Medical Services (Victims of Sexual Offences) (Scotland) Act 2021 and the Hate Crime and Public Order (Scotland) Act 2021. Furthermore, various pieces of secondary legislation have seen the implementation of the Domestic Abuse (Scotland) Act 2018, the establishment of the Victim Surcharge Fund, the creation of a statutory Appropriate Adult service, more flexible powers to pilot improvements to the victim statement scheme and changes to Parole Board Rules to ensure victims are better informed, more involved and receive greater support ahead of prison release decisions.

Data is not available at this time on the number of times body worn cameras have been used by Police Scotland as evidence to secure a conviction.

Should the decision be made to rollout the use of body worn cameras to other roles across Police Scotland, a range of data will be gathered to assess the impacts of the rollout including quantative data relating to criminal justice processes.

The information requested is not held centrally by the Scottish Government. The allocation of resources, and the Health and Wellbeing of Police Officers and Police Staff, are matters for the Chief Constable of Police Scotland and the Scottish Police Authority. Despite constraints on Scotland’s public services through a decade of UK austerity, policing services have been maintained and improved and we will protect the police resource budget in real terms for the entirety of this Parliamentary term, as we did for the last. We have invested over £10 billion in policing since the creation of Police Scotland in 2013 and have increased the policing budget by £75.5 million in 2021-22.

Police officers and staff can access a range of services to care for their physical and mental health through Police Scotland's “Your Wellbeing Matters” programme. This includes the introduction of Wellbeing Champions, and has resulted in raised awareness of the services available such as occupational health and employee assistance, which offer counselling, and specific interactions through the Trauma Risk Management programme (TRiM).

We have made a commitment to increase the direct investment into mental health services by at least 25% and ensure that, by the end of the parliament, 10% of our frontline NHS budget will be invested in mental health services.

We have also set our plan to prevent, mitigate and respond to the mental health impacts of the Covid-19 pandemic through our ‘Mental Health Transition and Recovery Plan’, published in October 2020, which sets out our response to the mental health effects of the Covid-19 pandemic, containing over 100 actions. The Plan is supported by a £120 million Recovery and Renewal fund, announced in February 2021. The Fund will transform services, with a renewed focus on prevention and early intervention. We expect total spend, including by NHS Scotland, on mental health in 2021-22, to be in excess of £1.2 billion.

Under the Environment Act 1995 and associated regulations all Scottish local authorities are required to regularly assess air quality in their areas against objectives for several pollutants of concern for human health, including PM2.5 particulate matter. If any objective is found to be exceeded, or at risk of being exceeded, the authority concerned is required to declare an Air Quality Management Area and produce an action plan setting out how it will address the issues identified. These action plans are agreed by both the Scottish Government and SEPA.

To date no local authority has identified an exceedance of the PM2.5 objective relating to the Scotch whisky industry. However this is kept under regular review, with all authorities required to submit an annual air quality progress report to the Scottish Government. Should the situation change in any local authority area, we would expect the necessary action to be taken.

Community benefits are increasingly included in public procurement contracts. As a result, thousands of employment and training opportunities have been achieved, contributing to national and local outcomes and achieving a positive social impact.

In 2016, the Scottish Government issued Statutory Guidance under the Procurement Reform (Scotland) Act 2014, setting out how public bodies can include community benefits in relevant public procurements. In 2020, we published guidance for public bodies on ‘ Measuring social impact in public procurement (SPPN 10/2020) ’. This includes a focus on the use of community benefits and examples of how public procurement has been used to deliver social impact in communities.

Our sustainable procurement tools include additional guidance on employment, skills and training through public contracts.

The completion rate for Community Payback Orders (CPOs) has generally been around 70% over the last seven years. This is consistently higher than for the orders they replaced.

There are a range of factors which can influence the likelihood that an order will be successfully completed. In particular, outcomes are likely to be influenced by the nature of the offending behaviour and individuals’ underlying risks and needs. The proportion of orders with an offender supervision requirement rose to 62% in 2019-20, the highest level in the last five years. Greater use of supervision suggests that individuals have more complex and entrenched issues to address and may have greater likelihood of reoffending.

Local authorities are responsible for delivering CPOs and, notwithstanding the factors noted above, we are continuing to work with national and local partners to help ensure orders are implemented as effectively as possible, and that completion rates are as high as they can be. Specifically, effective practice and improvement is supported by:

• a programme of scrutiny and assurance work carried out by the Care Inspectorate, funded by Scottish Government
• ongoing training and support from national partners, including Community Justice Scotland, Social Work Scotland, and Scottish Government
• analysis of statistics which are disaggregated by local authority areas, practice support groups organised by Social Work Scotland, area based CPO annual reports and an annual CPO report prepared by Community Justice Scotland

In addition, the Scottish Government has protected record levels of funding with up to £106 million allocated in 2020-21 to local authorities for the delivery of justice social work services. An additional £11.8 million has been provided this year to support justice social work recovery relating to the impact of coronavirus, which had a significant impact on the delivery of CPOs.

The Adoption and Children (Scotland) Act 2007 sets out a statutory duty for local authorities to provide adoptive families with the support that they require, like the provision of counselling, guidance and any other assistance in relation to the adoption process that the local authority considers appropriate in the circumstances of that particular case.

As the support required by adopters and their families varies significantly from case to case, the Act provides the flexibility for individualised support plans to be developed to best meet the needs of families, at a time that is right for them.

The Promise Report of the Independent Care Review made it clear that adoption has an important role in providing permanent, loving nurturing home and set out that an adoption placement should not be the conclusion of the support offered to adoptive families. The Promise makes clear that all families need support to thrive. Through the work of the Family Support Delivery Group we are working in partnership with the third sector, statutory services and across government to deliver a vision that ensures all families can access the right support when they need it for as long as they need it, aligned with the implementation of the Promise.

There has been no increase to the funding allocated from the Scottish Government’s Children Young People and Families Early Intervention Fund & Adult Learning and Empowering Communities (CYPFEI & ALEC) Fund to the Scottish Youth Parliament in 2021-22.
