To ask the Scottish Government what impact the cyberattack on SEPA had on the processing of planning applications.
Answer
After suffering a substantial cyberattack in December 2020, SEPA enacted business continuity arrangements and implemented procedures to ensure priority planning and business critical cases were responded to.
SEPA worked with planning authorities and other consulting bodies, providing practical planning advice. By August 2021, SEPA had processed the backlog of cases and to date have responded to 1597 consultations.

To ask the Scottish Government how many patients in NHS (a) Greater Glasgow and Clyde and (b) Ayrshire and Arran have waited longer than the 12-week waiting time standard for an outpatient appointment for orthopaedic treatment in each month since January 2020.

The number of patients who have waited over 12 weeks for Trauma and Orthopaedic surgery in NHS Greater Glasgow and Clyde and NHS Ayrshire and Arran are published by Public Health Scotland (PHS) on a quarterly basis. I have asked Teresa Medhurst, Interim Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:
The SPS awarded the pre-construction services contract for the HMP Highland project to Balfour Beatty in September 2021.
The SPS are working with Balfour Beatty to further develop the design of HMP Highland, prior to the award of a stage two contract that will deliver the construction element of the project.

To ask the Scottish Government what correspondence it has had with local authorities and COSLA in relation to raising awareness about claiming pension credit and supporting people to do so.
Answer
Pension Credit is reserved to the UK Government and, therefore, the Scottish Government has not corresponded with local authorities or COSLA in relation to raising awareness about claiming pension credit or supporting people to do so.
The Scottish Government funds the Citizens Advice Network in Scotland to deliver the Money Talk Team Income Maximisation Service. This is a money advice service that includes advice about all benefits, including pension credit. We have undertaken three national marketing campaigns to make people aware of the service.

To ask the Scottish Government where the money for the Victim Centred Approach Fund has been allocated from for the financial years from 2022-23 to 2024-25.
Answer
The spending plans for 2022-23 will be announced in the Scottish Government budget which will be published on 9 December and plans for future years will be considered as part of the Resource Spending Review .

To ask the Scottish Government how it plans to mitigate any impacts on rural businesses due to the deposit return scheme, in light of four of the 12 organisations consulted in its Scottish Firms Impact Test expressing concerns about logistical and/or critical mass issues, including additional costs to retailers in islands communities due to the need to ship goods by ferry.
Answer
We engaged closely with islands communities as part of the policy-development process for DRS, culminating in an Islands Communities Impact Assessment ( Deposit return scheme for Scotland: islands communities impact assessment - gov.scot (www.gov.scot) ).
We consider that our design for DRS takes full account of the needs of businesses, including retailers, operating in islands communities. In particular, the DRS scheme administrator will be required to collect containers free of charge from retailers to ensure they do not incur costs associated with transporting scheme articles for recycling.

To ask the Scottish Government which genomic tests that identify companion biomarkers for access to medicines accepted by the Scottish Medicines Consortium are not currently available in NHS Scotland, and what the timeline is for these tests to be available to NHS Scotland patients.
Answer
The National Services Division (NSD) in NHS National Services Scotland (NSS) have commissioning responsibility for the Scottish Genetic Laboratories. NSD are currently conducting a review of NHS Scotland’s genomic services which includes a review of the Scottish genomic test directory and genomics infrastructure. The review is expected to be completed by the end of the 2021-2022 financial year.
The outcomes from the review will be considered by the Scottish Genomics Leadership Group (SGLG), chaired jointly by Professor David Crossman, Chief Scientist for Health for the Scottish Government, and Susan Buchanan, NSD Director, who are supporting the Scottish Government in ensuring appropriate planning and robust decision-making processes are in place for genetic testing availability in Scotland.
In addition, the SGLG and NSD are working closely with the Scottish Genetics Laboratory Consortium and the Scottish Medicines Consortium to understand the laboratory capacity requirements for current and future medicines requiring a companion diagnostic test.

To ask the Scottish Government what its response is to the Lord President and Lord Justice General recommending to the Judicial Appointments Board for Scotland that an extra 15 fee paid sheriffs and 15 fee paid summary sheriffs be appointed.
Answer
In January 2021 I announced that £50 million would be allocated to support the justice system “Recover, Renew and Transform Programme”, which includes addressing the national requirement for a higher number of both sheriff and summary sheriff roles to manage the backlog in the sheriff courts that occurred due to the Covid-19 pandemic.
To support this programme of work, the Lord President made a formal request to Scottish Ministers for 15 fee paid sheriffs and 15 fee paid summary sheriffs to be appointed by the end of 2021. In April 2021, Scottish Ministers formally requested the Judicial Appointments Board for Scotland (JABS) begin the recommendation for appointment process to fill these roles. Subsequently recommendations for appointment are expected to be received from JABS in November 2021.

To ask the Scottish Government what plans it has to introduce or reintroduce any empty homes grants that aim to bring properties back into the social rental sector.
Answer
Funding from the Scottish Government’s Affordable Housing Supply Programme can, and already is, being used by a number of local authorities to buy-back empty homes. Our proposals for Housing to 2040 include an action to establish a new fund for local authorities to bring empty homes back into use and convert suitable empty commercial properties in town centres into residential use.
