Scottish Ministers cannot commission the Migration Advisory Committee (MAC) to consider changes to the Shortage Occupation List (SOL).

The Scottish Government responded to recent reviews of the SOL with detailed evidence on labour market shortages and how the SOL could more suitably meet Scotland’s distinct needs. We also provided evidence calling for the permanent addition of social care roles to the SOL with key roles subsequently added to the List as per the MAC’s recommendation.

Scotland has distinct population challenges, the January NRS population projections reinforce the need for a migration policy tailored to our needs. We remain dependant on a UK Government immigration system that fails to address Scotland’s distinct demographic, labour market and economic challenges. We need a responsive system that allows us to decide how to accommodate our distinct labour market needs.

Given the changes to the UK immigration system, the role of the SOL must be reviewed so that there is clarity as to its purpose and benefits. The Scottish Government must also be given a formal role in determining occupational shortages in Scotland.

The Scottish Government through the Scottish Freight and Logistics Advisory Group previously conducted an assessment of HGV rest stops and facilities in 2010-11.

The Scottish Government regularly engages with local authorities and the wider public sector, including through COSLA and the Sustainable Scotland Network (SSN), where current opportunities and challenges within local authority climate action are frequently discussed. Scottish Government officials also engage with the Improvement Service on the capacity needs of local authorities in delivering net zero.

Through the cross-sectoral Climate and Procurement Forum and underpinning work streams, we work together with local authorities and other sectors to advance the capability of the wider public sector in addressing the Climate Emergency. For example, in partnership with Scotland Excel we reviewed demand for Climate training in 2020 and in response to this created Climate Literacy e-learning. This was launched in March 2021 and by end June 2022 had been completed by over 150 users across 20 Local Authorities in Scotland. The Climate Literacy training has been augmented by updated tools and guidance on our Sustainable Procurement tools platform ( Sustainable Procurement (sustainableprocurementtools.scot) )

We published new climate leadership guidance to public bodies, including local authorities, in October 2021. This includes specific guidance on reducing indirect Scope 3 emissions including those from procurement.

The Scottish Parliament’s Net Zero, Energy and Transport Committee is currently conducting an inquiry into the role of local government and its partners in financing and delivering a net zero Scotland. In addition, Environmental Standards Scotland (ESS) recently launched an investigation into support for local authorities in delivery of climate change targets. Scottish Government welcomes such independent scrutiny and will give the resulting reports and recommendations due consideration

Identifying the number of individuals monitored electronically in each year is not possible from the data held without significant further analysis to remove from the data, those individuals who may have received multiple orders and licences over the period.

However the number of installations onto electronic monitoring made each year (with the caveats below) is a reasonable proxy for monitored individuals.

An installation is the action to fit a monitoring tag, irrespective of the licence or order monitored. While most electronically monitored individuals will be installed on an order or licence only once in a year, the same individual may have more than one installation in the course of a year, for example, if they have a subsequent new order or licence in that time period.

The impact of COVID-19 has been felt across all services within the justice system including within courts and prisons. During the financial year 2019-20 the number of installations of those electronically monitored (court orders and licences) was 4030, however the number then significantly dropped during the periods of COVID-19 disruption.

The numbers of those currently monitored are continuing to rise and we are now once again approaching some of the highest levels of monitoring we have seen.

The second part of the question asks for a breakdown by local authority area. This information is not currently held (although breakdown by issuing court area for example is possible). However a recent systems change from June 2022 means this breakdown by local authority area will be possible in future years.

Keith Brown: I have asked Teresa Medhurst, Interim Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

SPS is currently preparing a new Health & Wellbeing Strategy to address health inequality among prisoners. The Strategy is being drafted to align with the development of the SPS 2023-2025 Corporate Plan.

Scottish Ministers have to date provided £2.4m of funding to local authorities to allow them to undertake their required road assessments. Additionally, Transport Scotland have consulted with Local Authorities and the public on the proposed Ministerial Directions and secondary legislation, which will detail procedures Local Authorities must follow to exempt any areas of footway from the pavement parking prohibition.

Transport Scotland has also consulted with local authorities on the proposed Parking Standards Guidance, which will formally be issued to all local authorities once the exemption order procedures are in place.

It is currently envisaged that the exemption order procedure regulations will be laid in Parliament in the latter part of September and come into force in early December, if approved. Following this, local authorities will have an additional 12 months to complete their assessments and put any exemption orders in place.

The Scottish Government has accepted the recommendation by the independent Doctors and Dentists Pay Review Body (DDRB) of an annual pay uplift of 4.5% for NHS medical and dental staff for this year backdated to 1 April 2022. This is for all NHS Scotland medical and dental staff, general medical practitioners and general dental practitioners.

The Scottish Government continues to work closely with COSLA to find a way forward on the introduction of a Scottish Recommended Allowance for foster and kinship carers.

The Roads (Scotland) Act 1984 places statutory responsibility for local roads, including structures, improvements, maintenance and repair with local roads authorities. As such it is the responsibility of the local authority to determine how best to meet its duties on local roads in their respective areas and no formal guidance is issued on this matter. Transport Scotland does however share knowledge and best practice through a number of forums. In particular the benefits of Warm Mix Asphalt has been discussed at a number of Transport Scotland Pavement Forums and representatives of SCOTS (Society of Chief Officers of Transportation in Scotland) attend these meetings.
