Residents in Dumfries and Galloway should continue to contact their Health Board for up-to-date information on dental practices that are registering new NHS patients. NHS Dumfries and Galloway can be contacted by email at: dg.pcd@nhs.scot.

I appreciate, given distances, this might not be appropriate but, residents in Dumfries and Galloway may wish to register with a dental practice in a different Health Board area and if this might be appropriate should contact the relevant Health Board to obtain information on those practices accepting new patients.

As required by the Grant Agreement, ScotRail has consulted its May 2023 timetable with statutory consultees including Regional Transport Partnerships, Transport Focus and other public transport operators such as Calmac. No specific objectives are set by the Grant Agreement for consultation with statutory consultees. The May 2023 timetable is an interim position which seeks to deliver as reliable as possible a service for customers with the resources ScotRail currently has available, specifically traincrew.

ScotRail has developed further timetable proposals for Ayrshire, Inverclyde, Glasgow South Electrics and Edinburgh to Glasgow via Shotts routes and aims to publicly consult these in the coming months. The objectives set for the public consultation are:

1. To encourage customers and stakeholders to have their say and help shape the future of Scotland’s Railway.

2. To promote the proposed timetable changes and consultation as a positive step in the railway’s road to recovery.

As part of our New Deal for Local Government, we are working with COSLA to agree a Fiscal Framework for Local Government, with the aim of delivering greater flexibility over financial arrangements, improving accountability for the delivery of national priorities, including net zero objectives, whilst ensuring maximum value for money. We anticipate the new Fiscal Framework will facilitate opportunities for greater local fiscal empowerment in the future, and aim to give councils more flexibility with greater scope for discretionary local revenue-raising. This will include exploring new ways to raise revenue and reviewing existing local taxes and powers, to make best use of all available and potential sources of local funding.

The Scottish Government will consult on the next Climate Change Plan, a draft of which will be published in November 2023. Plans for consultation are still in development.

To enable Ministers to reach a decision on the next steps for the Deposit Return Scheme, a number of discussions were held with those involved in the scheme in the weeks prior to the announcement including Circularity Scotland and business groups. The First Minister then met with Circularity Scotland on 20 April 2023.

The Bathing Waters (Scotland) Regulations 2008 Reg 4 states Scottish Ministers and the Scottish Environment Protection Agency (SEPA) must exercise their relevant functions so as to take such realistic and proportionate measures as they consider appropriate with a view to increasing the number of bathing waters classified as “good” or “excellent”. However, there is no obligation to take measures which would result in disproportionate expense or where any change in classification is infeasible.

Following significant investment and improvements in the first two cycles of river basin management planning, 98% of Scotland’s designated bathing waters now meet ‘sufficient’ or better environmental water quality standards, and more bathing waters are now rated as ‘excellent’ than ever before.

During the third cycle we continue to apply measures to protect bathing waters aiming to achieve further good or excellent classifications, avoiding deterioration and implementing plans to ensure that the health of bathers at designated sites is protected”. SEPA will continue with a focused approach in diffuse pollution priority catchments to drive compliance with environmental legislation to help achieve water quality objectives and improve bathing water quality.

The Scottish Environment Protection Agency is responsible for monitoring, classifying, protecting and improving designated bathing waters with aim to reduce the risks to human health, where a large number of people bathe, by protecting and improving bathing water quality. SEPA monitors and classifies bathing waters on an annual basis following strict EU standards and publishes the results on its’ website. Bathing Waters : Summary of last season (sepa.org.uk) .

The Bathing Water (Scotland) Regulations 2008 Reg11(4) requires that for bathing waters classified as poor SEPA must take such action as it considers necessary, whether in relation to the regulation of any controlled activity or under any other functions to ensure that the bathing water can be classified as “sufficient”, “good” or “excellent”, unless permanent advice against bathing has been issued.

The following table shows that the number of bathing waters designated as good and excellent has steadily increased in the past three years.

As set out at Section 2.38 of the Ministerial code Ministers must not divulge either who provided the advice or its contents (whether it is from the Law Officers or from anyone else). This applies to all forms of legal advice, including advice on a particular subject or advice associated with clearance of a document.

As this is an operational matter for Scottish Water [and this data is not held by Scottish Government] I have asked them to respond. Their reply is as follows:

In respect of published guidelines on reporting, Scottish Water is not currently required to report the number of days for which overflow event monitoring is unavailable. Overflow events are calculated in January using available telemetry data downloaded throughout the year.

As part of Scottish Water’s annual reporting of overflow events, a lack of data available would be noted within the commentary along with any additional explanatory information.

As outlined within Scottish Water’s Improving Urban Waters Routemap, there is significant investment underway to increase data monitors on our overflows by 2024. As part of this work, data capture and availability is being reviewed to allow further enhancements. In due course, we will publish information on the number of days for which monitors are unavailable to support the reporting of 2023 overflow events in January 2024.

The Scottish Government is enabling access to superfast broadband through the £600 million R100 contracts (North, Central and South) and the R100 Scottish Broadband Voucher Scheme (SBVS).

All three island local authority areas are covered by the R100 North Contract, with build already underway in Orkney and Shetland which is expected to conclude in 2026. Build is currently expected to begin in Na H-eileanan Siar in 2025 and conclude in 2028.

In 2022, as part of the R100 North contract, 16 new subsea fibre broadband cables were laid, providing future-proofed, resilient connections to 15 Scottish islands, including 4 islands in Shetland and 7 in Orkney.

All premises not in commercial or R100 contract plans can access a minimum of a superfast service via the R100 Scottish Broadband Voucher Scheme. However, this is a demand-led scheme, meaning it is ultimately up to tenants and owners to secure a connection through this route.

Last year the Scottish Government consulted on proposals for a National Litter and Flytipping Strategy. The consultation included proposals to encourage behaviour change, improve infrastructure and services and strengthen enforcement, including a review of the current enforcement model. A final strategy will be published this year.

In addition, we are supporting local authorities to prepare for the introduction of the Deposit Return Scheme next year, which will help to reduce the amount of waste, including litter, that local authorities have to handle, reducing the £36 million of public money spent annually on associated litter clean-up costs.

We will also be taking forward action to strengthen enforcement through the planned Circular Economy Bill this year.
