As set out in the answer to S6W-15782 on 20 March 2023, stakeholders will be consulted on a draft report in April. Following this the Steering Group will produce a final report which will be submitted to Ministers and published in due course thereafter.

Further to my letter to you dated 11 January 2023, an incident or pattern of wildlife mortality can be determined to be a “major conservation concern” where it might have an impact on the conservation status of the species concerned. This could be because of the scale of the impact, or because of the vulnerability of the species in question.

The conservation status relating to species can be found in the International Union for Conservation of Nature Red List of Threatened Species. The IUCN Red List of Threatened Species determines the listings on the UK Birds of Conservation Concern, and Species of European Conservation Concern.

Further information about each of these policy matters is as follows.

(a) Conversion therapy

A ban on conversion therapy was a commitment in the SNP’s 2021 manifesto. It was agreed by Cabinet in August 2021, both as part of the Bute House Agreement and as part of the Programme for Government 2021-22.

(b) Deposit Return Scheme

A commitment to introduce a Deposit Return Scheme was agreed by Cabinet in August 2017 as part of the Programme for Government 2017-18.

Cabinet agreed the design of the Deposit Return Scheme in April 2019 and agreed the original commencement date for inclusion in legislation in January 2020.

The Deposit and Return Scheme for Scotland Regulations 2020 were approved by the Scottish Parliament in May 2020 and Parliament agreed The Deposit and Return Scheme for Scotland Amendment Regulations 2022 in February 2022.

Cabinet has been updated and had the opportunity to comment on the implementation plans for the scheme on many occasions.

(c) Alcohol advertising

A commitment to introduce restrictions on alcohol advertising in locations where children would be readily exposed to it was included in the SNP’s 2021 manifesto. A commitment to consult on such restrictions was agreed by Cabinet in August 2021 as part of the Programme for Government 2021-22. The Cabinet Sub-Committee on Legislation approved the publication of this consultation paper in November 2022.

(d) Safe access zones

A commitment to support any local authority that wants to establish byelaws to create protest-free buffer zones outside clinics that provide abortion services was included in the SNP’s 2021 manifesto. Cabinet agreed this commitment in August 2021 as part of the Programme for Government 2021-22. The Cabinet Sub-Committee on Legislation agreed to support the development and drafting of Gillian Mackay’s Member’s Bill (the Proposed Abortion Services Safe Access Zones (Scotland) Bill) in July 2022.

We shared the results from the goose management policy questionnaire and discussed priorities at the National Goose Forum meeting on‎ 14 February 2023, however a draft report of the review of goose management policy was not ready in February to be shared.

We expect to consult further with stakeholders to allow them to comment on a draft of the report in April.

My deepest thoughts and condolences remain with the family of Allan Marshall. There is now a live police investigation and it would be inappropriate for the Scottish Government to comment on that investigation. The Scottish Government will cooperate with any investigation undertaken by Police Scotland.

Since the response to question S6W-15443 on 8 March 20232, further legal fee claims have been paid. As of 15 March 2023, £124,650 has been paid to 10 firms.

It is not appropriate to name the firms as to do so could be interpreted as guiding applicants to particular firms. Applicants are directed to the Law Society of Scotland for support in finding a solicitor. In addition, as some firms have a claim in respect of only one application there is a small risk of applicant identification if the full list is provided.

The Scottish Government has regular communication with the UK Government on a range of issues relating to human trafficking and exploitation, including the vacant role of Independent Anti-Slavery Commissioner.

Section 40 of the UK Modern Slavery Act 2015 sets out that the Secretary of State must appoint an Independent Anti-Slavery Commissioner.

While we understand that a second appointment round is now underway, the delay in replacing the former Commissioner is unacceptable at a time of UK Government legislation which seeks to prohibit access to vital support and assistance for victims of human trafficking and exploitation in Scotland.

There are 56.3 Whole Time Equivalent (WTE) obstetrics & gynaecology staff working in NHS Lanarkshire as at December 2022.

There are 35.7 Whole Time Equivalent (WTE) obstetrics & gynaecology staff working in NHS Forth Valley as at December 2022.

This includes staff at all medical grades.

The Scottish Government places great importance on swimming pools, and recognise the physical, social and economic benefits these facilities provide to communities across Scotland.

Whilst we have not undertaken an assessment of the social and economic impacts of swimming pool closures, the Scottish Government is working with sport scotland to accurately understand the current facilities provision and predict the landscape in the short, medium and long term by supporting Scottish Swimming to deliver the Scottish Swimming Facilities Project.

We have asked sport scotland to write to Ms Monica Lennon MSP with more details of the Scottish Swimming Facilities Project and to keep her updated as it progresses.
