The Legal Aid Fund is demand-led and directly linked to application numbers and all eligible costs are met. The Scottish Legal Aid Board’s Annual Accounts and Report 2023-24 show that the total cost of legal aid has increased 12% on the previous year to £151 million, 16% higher than the pre-pandemic year of 2019-20 and just under £10 million above the Scottish Legal Aid Boards’s budget of £141.3 million. Indications for this financial year show that expenditure levels are predicted to rise to around £171 million which will be the highest ever recorded.

Fees were uprated in 2019 by 3% and in 2021 by 5% and a further 5% came into effect in April 2022. Fees were increased most recently in April 2023 implementing an £11 million package of legal aid reforms and an uplift worth 10.25%. The compound effect of these increases is just over 25% and is a year-on-year increase in expenditure and investment in legal aid.

The most recent increase came into force on 29 April 2023, taking the total additional funding in legal aid to £31 million since April 2021.

In addition to fee increases, other forms of investment have been delivered by the Scottish Government. In 2021 a further £9 million in funding was also made available to assist legal aid providers through the pandemic.

The Scottish Government also provided funding to establish 40 traineeships in legal aid firms during 2021. The total additional funding package for legal aid providers between 2021-22 was worth £20 million.

The current Traineeship Fund is due to end in March 2025. Learning lessons from previous grant funding projects such as this is extremely important, and the outcome of the evaluation will help shape and inform any decisions with regards to a future Traineeship Fund.

It is important that before any decisions are taken, we continue to have constructive and meaningful dialogue with our stakeholders, particularly the Law Society of Scotland.

The Scottish Government needs to ensure that funding is targeted where it is most needed. It is also essential that there is a clear evidence base of that need and that value for money for the use of public funds can be demonstrated in line with the Scottish Government’s Public Financial Manual.

Scottish Government officials continue to engage and contribute to the Microchipping Devolved Administration Working Group and on 11 October I wrote to the Secretary of State for Environment, Food and Rural Affairs, the Rt Hon Steve Reed OBE, MP expressing the Scottish Government’s support for the work being done by the Working Group towards a single point of search portal for all animals microchipped.

The Scottish Government continually reviews the support available to communities through the CARES scheme and uses this information to inform future support. An evaluation of the current contract, which is due to end on 31 March 2025, will be completed prior to the beginning of a new contract. Stakeholders will have an opportunity to input into this evaluation.

The Scottish Government has published an Invitation to Tender for the new CARES contract with a submission deadline on 26 November 2024. Ahead of publication, the Scottish Government gathered information from stakeholders via an in-person supplier engagement event and Request for Information. The feedback gathered from these engagements were taken into consideration when developing the new CARES Statement of Requirement.

The Scottish Government notes the University of Glasgow-led project and report ‘Welcoming Languages’, and officials are in contact with researchers from the University to consider the report’s findings and to ensure that learning from the project is shared with the education system.

The 1+2 Languages policy provides all pupils with an entitlement to learn additional languages from primary 1 (P1). Schools and local authorities make decisions on the specific languages taught based on the needs of their learners and local circumstances.

Currently, the first additional language, taught from P1, must be a language that can be taught to national qualification level (i.e. Cantonese, French, Gaelic (Learners), German, Italian, Mandarin, Spanish and Urdu) which includes some of the most spoken community languages in Scotland. The SQA is responsible for establishing and maintaining all national qualifications, and a range of criteria would need to be met before establishing any new language qualifications.

The second additional language, taught from Primary 5 (P5), can be any language. The latest survey of local authorities, taken in 2023, showed that some primary schools, supported by Education Scotland and Scotland’s National Centre for Languages (SCILT), are already offering a wider range of second additional languages including Polish, Arabic and Ukrainian.

The Scottish Government provides core funding annually to Health Boards for sexual health and blood borne virus (BBV) services. From 2018-19 to 2023-24, Health Boards received funding through the annual Outcomes Framework allocation to cover a range of outcomes, including sexual health and BBVs. It was up to Health Boards to decide how much to allocate to each outcome within this envelope. In order to give Boards more control over local priorities this funding was baselined in 2023-24.

Given the wide range of bodies that make up the public bodies landscape in Scotland, and that not all public bodies share the same relationship with Government, there are no set rules as to the frequency ministers and officials should meet with them. Ministers with portfolio responsibility for public bodies do meet with them on a regular basis, and I have met with multiple public bodies over the past 6 months.

Of the 131 public bodies referred to there are some public bodies such as Parliamentary Commissioner that Ministers are not responsible for, but those public bodies that Ministers have responsibility for, civil servants make up the public body sponsor team within the Scottish Government.

Sponsor teams are the first point of contact between an Non-Departmental Public Bodies (NDPBs) and the Scottish Government. They provide advice, help and support to the public body and advice on accountability, governance and performance to Ministers and Portfolio Accountable Officers both on an ad-hoc basis and as part of regular meetings. Sponsorship is flexible, proportionate and responsive; and facilitates positive relationships between the body and the Scottish Government. Each public body will have a Framework Document that outlines the working relationship between itself and the Scottish Government. The Framework Document should be published on the public bodies website and will set out expectations for regular meetings.

Our 2018 Diet and Healthy Weight Delivery Plan, A healthier future: Scotland's diet and healthy weight delivery plan - gov.scot (www.gov.scot) set out ambitious and wide-ranging action to deliver our vision for a Scotland where everyone eats well and has a healthy weight. We are taking forward a range of action across five key outcomes: giving children the best start in life; creating a healthier food environment; better access to weight management services; leadership and reducing health inequalities.

This includes our continued support for convenience stores to increase the accessibility of fruit and vegetables in more deprived areas, supporting businesses to reformulate their products to make them healthier, and maintaining funding to community food networks, to enable them to increase access to affordable, healthier food to their communities and to promote the health benefits of nutrition and physical activity.

We have updated the Nutritional Requirements for Food and Drink in Schools (Scotland) Regulations strengthening the provision of balanced and nutritious food to children. Our Scottish Milk and Healthy Snack Scheme promotes good nutrition to support healthy physical and brain development through the provision of healthy drinks and snacks in the earliest years.

The annual Scottish Health Survey (SHeS) Scottish Health Survey - gov.scot (www.gov.scot) provides key indicators relating to diet, including fruit and vegetable consumption, weight and physical activity, which we use to monitor progress towards our ambitious aim of halving childhood obesity by 2030.

Public Health Scotland (PHS) will provide updates on HIV statistics as part of the HIV in Scotland annual surveillance report. The latest report was published in September 2024 and the next release will be in Autumn 2025.

The HIV Transmission Elimination Delivery Plan was launched in March 2024. PHS is developing a monitoring and evaluation plan to assess progress against this plan and the Scottish Government will update Parliament on this in due course.

Section 40 of the Regulatory Reform (Scotland) Act 2014 introduces an offence of significant environmental harm and sets maximum penalties for convictions for this offence. As set out in the Scottish Government’s draft Annual Report on the Scottish Government's commitment to align with the European Union where appropriate that was laid on 31 October 2024, we are considering Directive (EU) 2024/1203 of the European Parliament and of the Council of 11 April 2024 on the protection of the environment through criminal law. As a part of our consideration of this Directive, we are assessing the provisions for qualified offences for conduct that causes widespread and substantial environmental damage to particular features of the environment, and comparing this with existing provisions in Scots law to protect the environment.
