To ask the Scottish Government what its position is on the proposals outlined in the Scottish Fire and Rescue Service’s service delivery review.

The Scottish Government supports the Scottish Fire and Rescue Service (SFRS) as it carefully considers how to adapt to the changing risks to remain effective and efficient, with firefighters in the right place at the right time.

SFRS is undertaking a Strategic Service Review and there will be a full public consultation, commencing at the end of June. SFRS will analyse the responses to that consultation before taking decisions on which options should be implemented over the next 5 years.

To ask the Scottish Government what assessment it has made of the fire and rescue coverage in rural areas, and how Scottish Fire and Rescue Service proposals would impact on rural communities.

The provision of fire and rescue activity is an operational matter for the Scottish Fire and Rescue Service (SFRS).

SFRS will be consulting on a range of options for change as part of its Strategic Service Review at the end of June. As SFRS delivers its services on a national basis, some of these options for change will impact on rural areas and better aligning resources with risk and demand. As part of this consultation, SFRS will publish evidence and rational for the potential changes and it also plans to engage with MSPs and members of the public.

To ask the Scottish Government what assessment it has made of the role of the Scottish Fire and Rescue Service in responding to non-fire related incidents, such as flooding, road traffic collisions, and medical emergencies.

The Scottish Government’s assessment of the Scottish Fire and Rescue Service’s (SFRS) response to any incidents is informed by regular engagement (at various levels between SFRS and the Scottish Government), annual and mid-year performance reviews and HMFSI reports.

The Chief Fire Officer has provided assurances to the Scottish Government that SFRS remains ready and able to respond to all relevant non-fire related emergency incidents that may occur across Scotland.

To ask the Scottish Government what measures are in place to ensure that the mental health and wellbeing of Scottish Fire and Rescue Service staff is supported, in light of the service delivery review proposals.

The Scottish Fire and Rescue Service (SFRS) has had extensive engagement with staff who could be impacted by the Service Delivery options for change. A full 12 week public consultation will take place from the end of June where staff, stakeholders and member of the public will be given the opportunity to express their views.

SFRS takes the mental health and wellbeing of its staff seriously and have a variety of measures in place. Updates have been provided at key stages, supported by intranet resources and newsletters. Potential impacts and options have been discussed, and wellbeing support is available to all staff.

To ask the Scottish Government whether a national impact assessment has been conducted in relation to any fire risk of battery energy storage system applications and developments, and what discussions it has had with the Scottish Fire and Rescue Service regarding this issue.

Scottish Government holds regular discussions with the Scottish Fire and Rescue Service (SFRS) about Battery Energy Storage System (BESS) sites. SFRS continually review and develop their operational response to any new and emerging technology to keep communities safe.

SFRS is responsible for enforcing general fire safety under the Fire (Scotland) Act 2005, while process-related fire risks at Battery Energy Storage System (BESS) sites fall under the Health and Safety Executive (HSE) via the Health and Safety at Work Act 1974. Monitoring these sites is the duty holder’s responsibility.

No national impact assessment has been conducted in relation to fire risk of BESS applications and developments. Where new development proposals come forward, our Fourth National Planning Framework (NPF4) ensures the impacts of proposals on communities and nature, including cumulative impacts, are important considerations in the decision-making process. All applications are subject to site specific assessments.

To ask the Scottish Government, in relation to family consent and post-mortem tissue retention, whether it has considered updating the Human Tissue (Scotland) Act 2006 to align with changes implemented in the Human Tissue Act 2004 for England, Wales and Northern Ireland.

The Scottish Government has no plans to change the Human Tissue (Scotland) Act 2006 (the 2006 Act) and believes that the Act sufficiently addresses consent and the handling of tissue in relation to post-mortem examinations.

The Human Tissue Act 2004 applies in its entirety in England, Wales and Northern Ireland. It allows for tissues/samples to be returned to the next of kin, whereas under the 2006 Act in Scotland these become part of the medical record. The 2006 Act includes a schedule for disposal of medical records in Scotland.

The current situation in Scotland is that where a post-mortem is instructed by the Crown Office and Procurator Fiscal Service (COPFS) as part of an investigation into a death, consent is not required and some samples may be retained for future evidentiary purposes. COPFS endeavour to inform the family in advance of such steps. Where a post-mortem is not part of a COPFS investigation into a death, for example where the death occurs in a hospital, consent is always required for the post-mortem from the next-of-kin or the deceased themselves in advance.

The Citizen Participation and Public Petitions Committee is currently considering the petition PE1911 – Review of Human Tissue (Scotland) Act 2006 as it relates to post-mortems. The petition calls on the Scottish Parliament to urge the Scottish Government to review the Human Tissue (Scotland) Act 2006 and relevant guidance to ensure that all post-mortems can be carried out only with the permission of the next of kin, do not routinely remove brains, and offer tissue samples to the next of kin as a matter of course.

On 8 August 2024, the Committee wrote to the Minister for Public Health and Women’s Health seeking views on the petition and asking about pathology services in Scotland. The Minister responded to the Committee on 19 September 2024, taking into account views from the Office of the Chief Medical Officer (CMO) and COPFS. The Minister noted that the Scottish Government had responded to the Committee’s call for a review of the 2006 Act, in particular regarding tissue sample handling, in the submissions of 15 November 2021 and 5 January 2022. The position has not changed, as it is essential that COPFS are able to undertake independent investigations into a cause of death, without which the death cannot be registered.

Scottish Government officials continue to work with COPFS and other partners to consider how current and future forensic pathology services may be improved.
