To ask the Scottish Executive whether it has any record of compliance with section 19(2)(b) of the Race Relations Act 1976 by companies operating public private partnerships.
Answer
Although the questionerrefers to section 19(2)(b) of the Race Relations Act 1976, the relevantScottish provision was section 19(3). The whole of section 19 of the 1976 actwas repealed by Schedule 3 of the Race Relations (Amendment) Act 2000 witheffect from 2 April 2001 by virtue of Statutory Instrument 2001/566. In anyevent, the general duty under section 19(1) only applied to educationalauthorities in Scotland by virtue of section 19(6) and companies operatingpublic private partnerships were never subject to this duty.
In July this year theCommission for Racial Equality published guidance for public authorities andpotential contractors on procurement and race relations legislation.

To ask the Scottish Executive which fire brigades have yet to complete the issuing of jubilee medals; what percentage of operational staff in each brigade are awaiting the issue of their jubilee medal, and when each brigade expects to complete issuing jubilee medals.
Answer
I understand that Grampian, Highland andIslands, and Strathclyde have yet to complete issuing the jubilee medal totheir operational staff. Some staff declined to receive a medal. The percentagestill awaiting medals is as follows: Grampian 11%; Highland andIslands less than 1%, and Strathclyde 50%-60%. The brigades expect to completethe issue of the medals by the end of 2003.

Answer
This is essentially a matterfor brigades. However, I understand that Central Scotland, Dumfries and Galloway, Fife, Lothianand Borders and Tayside have all issued operational staff with the jubileemedal.

To ask the Scottish Executive, further to the answers to questions S1W-33964, S2W-1868 and S2O-422 by Mr Jim Wallace on 24 February 2003 and Cathy Jamieson on 1 and 18 September 2003 respectively, whether it is considering any alteration of its contract with the operators of HM Prison Kilmarnock to increase the maximum allowed performance-related revenue deduction, given that the prison operators have been penalised for poor performance to the maximum allowed in the contract in seven quarters out of 17 in which the prison has operated, and what the reasons are for its position on this matter.

It is not current SPS policyto provide in-cell showers in mainstream young offender accommodation atPolmont because it would increase the capital cost per cell, thereby reducingthe pace at which the SPS can provide new accommodation, replace unsatisfactoryaccommodation and reduce slopping out.

To ask the Scottish Executive what the underspend in the Justice budget was for 2002-03 and under which budget headings the underspend took place.
Answer
The total net underspend forthe Justice budget for the financial year 2002-03 was £50 million. Detailed informationon the underspend and plans to allocate these resources in the current financialyear was sent to all members of Justice 1 and 2 Committees on 25 September, andis published on the Scottish Parliament website.
