To ask the Scottish Government whether (a) it, (b) Caledonian Maritime Assets Ltd (CMAL) and (c) any of its agencies were advised of a design fault with the cooling system and engine capacity of the MV Loch Seaforth when the vessel was being built and, if so, when.

The Scottish Government, including its agencies, and Caledonian Maritime Assets Ltd (CMAL), are not aware of any design fault with the MV Loch Seaforth’s water cooling system or of any engine capacity issues.

The new vessel which was commissioned by Caledonian Maritime Assets Ltd (CMAL) is:-

faster, quieter and more reliable than the previous vessels on that route
adaptable to accommodate growth in traffic
more fuel efficient and will consume significantly less fuel than the previous vessels that operated on the route

The water cooling system was designed by the shipyard Flensburger Schiffbau-Gesellschaft and approved by the Classification Society (Lloyds Register) and accepted by both CMAL and CalMac.

To ask the Scottish Government, further to the comment by the Cabinet Secretary for the Rural Economy on 13 September 2018 (Official Report, c. 45) that there is a “commitment to providing legislation to underpin Scotland’s status as a good food nation”, whether this legislation is included in the Programme for Government and, if not, (a) when it will be introduced and (b) whether it will provide details of what it will consist of.

To ask the Scottish Government what criteria it will use when allocating fishing opportunities (a) in 2019 and (b) following the Brexit transition period.

Fishing opportunities are allocated in a number of ways. Opportunities may take the form of quotas, monthly or weekly catch limits, specific licence conditions or, very occasionally, as days at sea, (effort).

Fishing vessel licences for vessels greater than 10m in length generally have Fixed Quota Allocation units (FQA units) associated with them. FQA units provide access to a fixed percentage of UK catch limits for each quota stock. The majority of over 10m fishing vessels are members of Producer Organisations who manage the quota on behalf of their members. The Scottish Government distributes quota to POs based on the FQA shares of their members, at this point management of the use of these quotas is delegated to the POs. Quota derived from FQA units of over 10m vessels who are not members of POs, is held in a pool, managed by the Scottish Government, with catch limits set on a monthly or weekly basis, providing equal access and opportunity to all vessels. Non-sectoral licences of vessels 10m and under in length are not permitted to hold FQA units. They fish against the 10 metre and under quota pool, managed by the Scottish Government, with catch limits set on a monthly or weekly basis, providing equal access and opportunity to all vessels.

(a) We will continue to allocate the fishing opportunities in 2019 according to the method described above.

(b) We will set out our approach to the future management of Scotland's fisheries in due course for the post Brexit transition period. Of course it is not yet clear when that will be.

To ask the Scottish Government what analysis it has carried out on the relationship between the Planning (Scotland) Bill, and the Islands (Scotland) Act 2018.

The Planning (Scotland) Bill was introduced to the Scottish Parliament before the Islands (Scotland) Act 2018 was passed.

In 2017, the Scottish Government made a commitment to island proofing the Planning Bill, in recognition of the particular challenges and opportunities for planning arising from the special circumstances of island communities. Following ongoing engagement throughout the course of the planning review, an intensive island proofing exercise was undertaken in collaboration with the Strategic Islands Group.

The Scottish Government and members of the Strategic Islands Group published an Island Proofing Statement in December 2017, which can be viewed at https://beta.gov.scot/publications/planning-bill-islands-proofing-statement/

The statement emphasised the importance of ensuring the planning system is sufficiently flexible to allow for island circumstances to be taken into account.

The statement will be updated and finalised following the conclusion of the Parliament’s scrutiny of the Planning (Scotland) Bill.

Work to prepare a National Islands Plan is at an early stage, and we will consider how it could align with development planning as this work progresses.

To ask the Scottish Government whether it has applied to the EU for a derogation from state aid rules regarding support for the Skye and Lochalsh Micro Abattoir Project and, if so, what the outcome was.

While funding for abattoir projects can generally be considered for Food Processing, Marketing and Co-operation (FPMC) assistance, the rules that govern the scheme limit the maximum rate of grant to 40% of eligible costs – irrespective of the status of the applicant.

The aid-intensity rules are derived from the EU’s guidelines on SMEs and the EU state aid rules that apply to measures funded through the Scottish Rural Development Programme. In addition, it is necessary to take into account the type of activity to be undertaken and there is no scope to deviate from this.

The Government continues to work with other public agencies, industry stakeholders and others to consider how best to secure adequate livestock slaughter capacity throughout Scotland.
