Answer
I responded to the Historic Environment Advisory Council for Scotland''s reports on heritage legislation and local government on 21 December 2007, and this was supplemented with further information on 29 January 2008. I have asked my officials in Historic Scotland to forward copies of both responses to you for information.

To ask the Scottish Executive what regulatory requirements apply to housing co-operatives.
Answer
I have asked James Hynd, ActingChief Executive of Communities Scotland to respond. His response is as follows:
Housing co-operatives, like housingassociations, are also known as registered social landlords (RSLs), which meansthey are registered with Communities Scotland. Communities Scotland regulates and inspects RSLs. All RSLs, including housingco-operatives, are required to meet the regulatory requirements set out in Part3 of the Housing (Scotland) Act 2001. Communities Scotland has a set of publishedPerformance Standards for all RSLs in Scotland. RSLs are required to comply with the standards. Theyare also required to submit annual financial and performance monitoring information.
We tailor our engagement withRSLs to take into account the size of the RSL. But where there are significant weaknessesor performance issues, we can use our statutory powers of intervention to ensurethat these issues are addressed and the interests of tenants are protected. Thesearrangements will continue under the new interim housing regulatory agency whichwill carry out the regulation of RSLs after Communities Scotland is wound up inApril 2008.

To ask the Scottish Executive what support is available to housing co-operatives.
Answer
The £93 million allocated fordevelopment of the third sector in the spending review recognises the existing contributionof third sector organisations, including housing co-operatives, and the potentialfor their entrepreneurial dynamism to contribute to transformational change acrossthe Scottish Government’s five strategic objectives.
The new Scottish Investment Fundis expected to come into operation later this year and applications will be invitedfrom properly constituted third sector organisations – organisations which are constitutedfor social purpose and principally non-profit distributing.
As registered sociallandlords, housing co-operatives are eligible to apply for Wider Role funding tohelp support regeneration activity they may be involved in beyond their principalrole as landlords.
A budget of £12 million per annumfor Wider Role for RSLs, for a three-year period starting on 1 April 2008 was includedin the draft budget announcement made in autumn 2007.

To ask the Scottish Executive what costs were incurred by the Crown Office and Procurator Fiscal Service as a result of the prosecutions that took place following the inquiry into the causes of the Stockline disaster.
Answer
The Crown Office and ProcuratorFiscal Service do not routinely record the costs of individual cases. However, officialsare able to estimate the cost of the ICL Tech and ICL Plastics Ltd prosecution frominformation available at £654,000.
