To ask the Scottish Executive whether supply partners purchasing services from self-employed advisers will be required to follow public sector procurement rules.
Answer
Publicsector procurement rules include European legislation, UKlegislation and administrative rules. The application of the public sectorprocurement rules is dependent upon the status and nature of the bodyconcerned.
Where a “supply partner” isa private sector body, it will be required only to comply with public sectorprocurement rules where it is obliged to do so as a condition of funding, or asa condition of contract or where, in purchasing goods or services, it is actingas an agent of a public sector body.

To ask the Scottish Executive when the approximately #4.5 million final tranche of the Arbuthnott settlement will be paid to NHS Highland.

To ask the Scottish Executive, further to the answer to question S1W-23566 by Mr Jim Wallace on 28 February 2002, where the further Public Defence Solicitors' Office pilot projects will be located.
Answer
After careful consideration,I have decided to locate one office in Glasgow and the other in Inverness, dealing with thecourts in Dingwall, Dornoch, Elgin, Inverness, Nairn, Tain and Wick. The offices will also be ableto represent clients in other courts if their services are sought. My officialsand those of the Scottish Legal Aid Board will be consulting the Law Societyabout the operational aspects of this decision. It is hoped to have these officesoperational by 30 June 2004.

To ask the Scottish Executive whether there are any plans to target anti-smoking information and advertising towards teenage girls.
Answer
Whilst there have been a substantialachievement in reducing the smoking prevalence among teenage boys it is disappointingthat there has not been a similar decrease in smoking rates for teenage girls. the Scottish Executive is currently undertaking a detailed review of tobaccocontrol policies with key partners. A tobacco control action plan will be publishedthis autumn which will cover a wide range of measures including communication andprevention activity for this important group during the years of teenage transition.

To ask the Scottish Executive whether it will rescind the Conservation of Seals (Scotland) Order 2002, given that the outbreak of phocine distemper virus in seal is now over.
Answer
The Conservation of Seals (Scotland) Order2002 was introduced on the basis of independent scientific advice from the NaturalEnvironment Research Council’s Special Committee on Seals, the Government’s statutoryadvisors on seal management issues. The future of the order will be decided in thesame way. The committee, which met to discuss this issue amongst others on 2 September,is expected to submit its conclusions towards the end of the year.

To ask the Scottish Executive when the planned safety measures at the North Kessock junction on the A9 will be in place and how much these measures will cost.
Answer
The planned safety measuresfor the A9 North Kessock junction will be in place by the end of this month,except for two of the four vehicle activated signs, which will be in place bythe end of November 2003. The estimated cost of the work is £80,000.
