The Scottish Government funds the National Autism Implementation Team (NAIT) to support local areas to improve their neurodevelopmental support and diagnosis for adults; this includes diagnosis for both autism and ADHD. Since we accepted the recommendations of the Adult Neurodevelopmental Pathways report last year, we have provided £567k for implementation to the NAIT. Nine of the 14 NHS Health Boards in Scotland now have Adult Neurodevelopmental Pathway Strategic Groups and five have a current Local Action Plan. Progress in this area remains a priority.

NAIT also published guidance in April (2022) regarding the prescribing of ADHD medication to adults following a private sector diagnosis in Scotland which can be read here .

NAIT’s guidance was constructed in consultation with practising psychiatrists, the Royal Colleges of Psychiatry and General Practice, as well as individuals with ADHD.

This guidance helps clarify the roles and responsibilities of both NHS staff and non-NHS providers.

There is no national collection of waiting times for adult diagnosis of ADHD. Such collection is conducted at the level of Health and Social Care Partnerships (HSCPs), and is not aggregated nationally.

However, the Scottish Government established the National Autism Implementation Team (NAIT), in partnership with Queen Margaret University, to support Health and Social Care Partnerships to consider best practice and improve service in the redesigning of autism diagnostic services.

In May 2023, NAIT published a review of waiting times for neurodevelopmental assessment in Scotland for adults , conducted between October 2021 and May 2022. These assessments include those for autism and ADHD.

This review found that, while the median overall waiting time for a diagnosis in adults was 252 days, aligning with the recommended timeframe, under half (47%) of individual assessments met the 252-day time standard, indicating that some individuals experience longer waiting times.

The 2020 Programme for Government included work to consider a National Clinical Pathway for ADHD. That work has now been completed and the Feasibility Study was published in January 2021 by the National Autism Implementation Team (NAIT).

Following on from the study, the Scottish Government provided funding of £650,000 for a 12-month pilot in four HSCP areas - Fife, Borders, Lanarkshire and Highland. The findings of the pilot were published in March 2023. We have accepted the full recommendations of the report and are now working with NAIT on implementation.

It is the responsibility of local Health and Social Care Partnerships (HSCPs) to put in place services to meet local needs, including the needs of adults with ADHD. Alongside this, the Scottish Government is engaged in work nationally to improve access to ADHD diagnosis in Scotland.

The Scottish Government funds Scottish Autism’s Autism Advice Line which is staffed by advisors who are trained and experienced in working with autistic people and their families. The Advice Line is open Tuesday – Friday, 10am-4pm. There is also a live chat facility, which you can access via the chat bubble at the bottom right hand corner of Scottish Autism’s website .

We also provide £1m of funding to several organisations via our Adult Autism Support Fund (AASF). Formal diagnosis is not required to access support from the new fund, which is directed at adults who currently receive very little local funding. The service is delivered in partnership with national charities and autistic led organisations, with Inspiring Scotland appointed as fund managers.

There are many other organisations across Scotland that run initiatives that support adults awaiting assessments for autism and/or ADHD. These initiatives do not require formal diagnoses as a prerequisite for access.

The Crown Office and Procurator Fiscal Service are in the process of finalising a comprehensive list of all Specialist Reporting Agencies, which will be made available within the next three months.

The Scottish Government is working closely with Samaritans Scotland, as one of our key partners driving the delivery of the suicide prevention Creating Hope Together strategy, to better understand help seeking behaviour and increase signposting to local and national support. We recognise that there may be benefits for some mental health patients in accessing Samaritans’ listening services alongside NHS care.

At present, Samaritans provide pre-printed freepost envelopes in prison settings as part of their broader work to support people in prisons. However, while there is no specific scheme to provide pre-marked envelopes within hospitals, any individual can write to them for free by marking an envelope “FREEPOST SAMARITANS LETTERS”.

Samaritans can also be contacted 24/7 by phone for free on 116 123 and by email at Jo@samaritans.org. They aim to respond to all emails within 24 hours.

We will continue to work alongside Samaritans Scotland to support any plans to further promote and expand access to its listening services within the NHS estate.

I have asked Teresa Medhurst, Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

SPS recognise the importance of those in our care maintaining contact with family and friends coupled with their ability to access support services such as the Samaritans.

Last summer SPS rolled out in cell telephony throughout our estate, which continues to support the positive mental health and wellbeing for those we care for and enables access to the Samaritans free of charge, 24 hours per day.

Any envelopes not marked with the “Freepost Samaritans Letters" address are being removed from use in establishments.

Migrant workers are essential contributors to our communities, public services, and vitally help address skills shortages.

Scotland’s Fair Work Action Plan sets out actions to become a leading Fair Work Nation by 2025.

The Scottish Government have funded the Worker Support Centre since 2022 to provide free and confidential support to seasonal migrant workers so that more of them understand their workplace rights and how to exercise them. RSABI (founded as the Royal Scottish Agricultural Benevolent Institution) provides practical, emotional, and financial support to all people involved in the Scottish agricultural industry.

Control over employment and industrial relations legislation is currently reserved to the UK Parliament; while this remains the case, we will continue to use our Fair Work policy to drive up labour market standards for workers across the Scottish labour market.

The Scottish Government recognises the importance of confirming funding allocations to partners as early as possible. We are working closely with NHS 24 to agree funding requirements for their mental health services in 2024-25, including for Breathing Space, and will confirm funding thereafter.

Under planning legislation set out in The Town and Country Planning (Scotland) Act 1997 (the 1997 Act) it is a breach of planning control to carry out any development, including the installation of replacement windows, without the required planning consent.

When a planning authority consider that a breach of planning control has occurred in their area, the planning authority has a range of powers available to them to ensure that the breach is rectified. These powers extend to requiring that any changes to the appearance of a building or land be reversed and the property in question restored to its original state prior to the unauthorised development taking place. Should any person responsible for the unauthorised development fail to comply with enforcement measures, the planning authority has the power to enter the land and carry out the required remedial work themselves, with the costs of such work being recovered form that person. Additionally the planning authority can seek to prosecute that person through the Scottish Courts with the maximum fine on summary conviction currently set at £50,000.

In the case of unauthorised works to a listed building, in addition to any action taken under the 1997 Act, the owner may also be subject to enforcement action under the Town and Country Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997. Again, they can be required to carry out any remedial work and can be liable to conviction with a fine of up to £50,000 on summary conviction.

The Armed Forces Pension Scheme and benefits including the War Pension Scheme are wholly reserved to the UK Government and are assessed and administered by Veterans UK on behalf of the Ministry of Defence. The Scottish Government is therefore unable to intervene on those matters. Nevertheless, the Scottish Government has previously been made aware of people experiencing issues with their pensions and Scottish Ministers wrote to former Ministers for Defence People and Veterans at the Ministry of Defence in 2021 and 2022 highlighting this. I will raise this again at my next meeting with the UK Minister for Veterans Affairs.
