The care provided by Scotland’s independent secure providers is highly-regarded. We need to consider how the secure care system operates overall in the coming years, taking in to consideration the asks from the Independent Care Review’s Promise and the incorporation of UNCRC, before embarking on any redesign work.

In the short term, the Children (Care and Justice) (Scotland) Bill will give effect to the necessary legislative changes to displace all under 18s from custody. Contractual and other non-statutory interventions to guarantee secure capacity and to minimise providers’ reliance on placements from elsewhere in the UK are already in train.

Over the coming years, preparing to keep the Promise by 2030 will likely entail a transformational change to the current secure provision for children in Scotland. A secure estate configured to meet Scotland’s future demands means we will need to undertake significant redesign activity with providers and purchasers. Resource shifts, system and practice change will also be required.

Alongside that, a national service specification for secure transport is being developed by the joint Scottish Government and COSLA led Secure Care Group. This specification aims to bring consistency to the expectations and requirements, wherever secure transport requires to be commissioned.

The Scottish Government recognises the critical role of advice services, often delivered by our diverse third sector and providing lifeline services to the most vulnerable communities during the cost crisis. We are directly investing around £12.5 million this year in free income maximisation, welfare and debt advice services delivered by third sector partners.

We recognise the impact that rising operating costs are having across society, including on charities and voluntary organisations, and we are committed to doing everything within our powers to support the third sector.

However, our ability to fulfil our devolved responsibilities and the support we would wish to provide remains a significant challenge due to the limitations on our parliament and the UK Government’s economic mismanagement.

ScotRail has provided the below data for its closed customer complaints since 1 April 2022, by four-weekly rail period, with the prior year (2021-22) and final pre-pandemic year (2019-20) included for comparison:

Our draft Energy Strategy and Just Transition Plan set out a series of actions, including the development of a refreshed Climate Emergency Skills Action Plan by the end of 2023.

Alongside this, as part of the ScotWind leasing round, developers were required to complete a Supply Chain Development Statement (SCDS). The SCDS outlines the supply chain activity that each project is committing to undertake within Scotland, the UK and overseas. These commitments amount to billions of pounds of investment in the Scottish supply chain and economy, with initial projections showing an average spend of £1.4bn across each of the 20 ScotWind projects.

Our Enterprise Agencies, including Scottish Development International, are engaged with a number of leading businesses that have the products, technology, skills and know-how to support robust supply chain development. We are encouraging developers to work with our Agencies and partners to identify how best to support and anticipate business needs as well as operational challenges to delivery of these projects.

We are already starting to see examples of companies establishing Operations and Maintenance (O&M) bases for their offshore wind farms in Scotland. In addition to the vast potential opened up by ScotWind, the Neart na Gaoithe O&M base was officially opened by the Cabinet Secretary for Net Zero, Energy and Transport on 25 January. This base will bring up to 50 high quality jobs to the Eyemouth area for the 25-year lifespan of the wind farm. The base is also large enough to handle potential staff expansion in summer months when the weather is calmer and maintenance can be increased.

The purpose of the occasional licence is to cater for the multitude of events which take place on premises which are not 'fully' licensed but feature the sale of alcohol. These can often include events arranged for the benefit of local communities such as local community fetes, gala day celebrations, wedding receptions and arts events. Occasional licences offer a flexible regime for the hospitality and entertainment sector to provide alcohol at events outside licensed premises.

The Scottish Government previously consulted on whether the current £10 occasional licence fee should be reviewed, and also whether the Scottish Ministers should make regulations setting limits on the number and duration of occasional licences granted. This follows concerns that occasional licences can be used in a manner designed to avoid the consequences of a permanent alcohol licence. Work in relation to this consultation was paused as a consequence of the coronavirus pandemic.

Having reflected carefully on this matter, the Scottish Government is minded to bring forward regulations which will put in place “occasional licence limits” in terms of the number of occasional licences, or the number of days on which occasional licences have effect, in relation to the same applicant or premises in any 12 month period.

The Scottish Government is also planning fresh engagement with licensing stakeholders to consider the level of fee currently charged for an occasional licence.

The approach of the Scottish Government will seek to balance the need for the cost and burden of occasional licences to be met by those seeking them while avoiding any undue impact on important local community events such as gala days and fetes. Any draft regulations would be subject to a targeted consultation and ultimately it will be for the Scottish Parliament to consider and approve.

The Scottish Government is committed to implementing the recommendations set out in the Coming Home Implementation Report to reduce delayed discharges and out-of-area placements for people with learning disabilities and complex care needs.

Careful consideration is being given to the call for a public inquiry, and the Cabinet Secretary for Culture, Tourism and External Affairs will respond to the Constitution, Europe, External Affairs and Culture Committee’s correspondence on this matter in due course.

Data regarding funding given to individual care homes is not held centrally by the Scottish Government. Neither is it held by the Care Inspectorate or Public Health Scotland.

Local authorities and integrated health & social care partnerships are responsible for commissioning services for people in their area. It is the responsibility of individual local authorities to manage their own budgets and to allocate the total financial resources available to them, including any public funding for care homes, on the basis of local needs and priorities, having first fulfilled their statutory obligations and the jointly agreed set of national and local priorities.

The Social Care Staff Support Fund is available for social care staff who are absent from work due to having covid-19, or self-isolating in line with public health guidance, to support and encourage infection prevention and control in social care settings.

Scottish Ministers strongly encourage employers to access the Fund on behalf of any staff member who meets all of the eligibility criteria.

The guidance on the Fund includes routes of recourse for any social care worker who has not received support from the Fund that they believe they are entitled to.

Local Authority and Health and Social Care Partnerships will have their own internal and governance processes in place and must adhere to their duties in relation to accounting for public funds. This includes ensuring that payments for additional costs are made in line with the Social Care Staff Support Fund Guidance.

Unlawful deduction of wages is completely unacceptable and any employees in this situation should seek advice.
