The Scottish Government is currently considering its position on the Assisted Dying for Terminally Ill Adults (Scotland) Bill moving forward, in light of Parliament’s decision to support the general principles of the Bill. In doing so, we will be taking care to ensure that any future steps are informed, balanced and respectful of the views expressed across the Chamber and the country. As part of this, we are carefully reflecting on the conclusions of the Health, Social Care and Sport Committee in their Stage 1 report.

The Children (Scotland) Act 1995 is the key legislation on contact, residence and parental responsibilities and rights. When the court is deciding whether to make an order under section 11 of the Act (e.g. a contact order) the driving principle of the legislation is that the welfare of the child must be the court’s paramount consideration.

The court must also – taking into account the child's age and maturity – have regard to any views the child wishes to express and have regard to the need to protect the child from any abuse (including domestic abuse), or the risk of any abuse, which affects or might affect the child.

It is for the court to decide what information and evidence it needs to make a decision about what is best for a child. The court may request a range of reports and information before reaching a decision and may appoint a child welfare reporter to get the child’s views or report on the best interests of the child.

The court can order that contact must take place at a child contact centre. This can either be supervised contact, when a trained member of staff observes the contact to ensure the safety of those involved, or supported contact, facilitated by staff who will support children and non-resident parent to meet and spend time together.

Public Health Scotland continues to provide data regarding planned procedure activity prior to March 2020 in the monthly Cancelled Planned Operations release which can be accessed at Cancelled planned operations - Month Ending 30 April 2025 - Cancelled planned operations - Publications - Public Health Scotland. The ‘Cancellations data’ file provides the information needed for comparisons of time periods May 2015 to April 2025 by month and therefore able to illustrate the difference in current levels of operation activity and operation activity pre-COVID-19 pandemic.

As part of PHS’ obligations under the UKSA Code of Practice for Statistics (found at About the Code – Code of Practice for Statistics), PHS continually review outputs to ensure they adhere to all the pillars contained within the Code of Practice. This states that “statistics and data [should be] useful, easy to access, remain relevant, and support understanding of important issues.” Upon review, the Cancelled Planned Operations summary has been adapted to align with these principles.

More specifically, in line with the principles of “Relevance to Users” and “Innovation and Improvement” the Cancelled Planned Operations commentary now reflects and highlights current trend patterns within 3 years from the latest release. The aim of the revised time trend highlighted within the summary is to meet the user need of improving access to latest trends and highlights important current information. The risk of including too much of a historic time trend in the summary chart is that it becomes more difficult to interpret these current trends. Nevertheless, the continuation of the provision of the longer time trend within the accompanying data tables, including activity prior to March 2020, allows the user to access the data if they wish to do so.

The Assisted Dying for Terminally Ill Adults (Scotland) Bill was introduced to the Scottish Parliament on 27 March 2024 by Liam McArthur MSP (Liberal Democrats). As such, this is a Member's Bill, not a Scottish Government Bill.

As with all Bills, at Stage 2 of the Bill’s passage through Parliament it is for the Convener of the lead Committee to make a decision on the admissibility of any amendment put forward.

At Stage 3, it would be for the Scottish Parliament’s Presiding Officer to make decisions on admissibility.

It is the Scottish Government’s view that both parents should be involved in their child’s life, as long as this is in the child’s best interests.

There is no legal presumption in favour of contact contained in section 11 of the 1995 Act. It is for the court to decide what information and evidence it needs to make a decision about what is best for a child, based on the facts and circumstances of the case.

However, recent research suggested there is a general presumption that contact is in the child’s best interests: Domestic Abuse and Child Contact: The Interface Between Criminal and Civil Proceedings - SCCJR.

Following this research, the Scottish Government has held workshops with key stakeholders on how to improve the interaction between the civil and criminal courts in the context of domestic abuse. The Scottish Government is currently considering potential changes to take forward.

We have established the National Oncology Coordination Group to provide a coordinated and collaborative response to immediate and foreseeable service pressures. This group provides rapid real-time assessment of highest risk services and proactively develops risk mitigation proposals, in line with the overall strategic aim for cancer. Officials also meet with Boards’ Cancer Management Teams monthly to identify immediate challenges, explore solutions and share best practice.

The Scottish Government has mobilised an ambitious Oncology Transformation Programme and are working closely with NHS Board and regional leaders from across the country to address longer-term pressures. We have also committed to further funding for Chemotherapy and Acute Oncology services using a phased approach to ensure we build a sustainable workforce. The funding will reach up to £10 million per annum and will support increased regional working, workforce recruitment and maximise capacity across the existing workforce. £6.6 million has been provided in 2025-26 and will support NHS Boards to develop sustainable plans.

The Scottish Government wants to ensure that the child’s best interests are at the centre of any contact case and that the voice of the child is heard. Family circumstances can vary considerably and so, beyond those general principles, there is no single approach which will fit every contact case.

Contact orders are made by courts under section 11 of the Children (Scotland) Act 1995. Through these orders, courts can regulate the arrangements under which non-resident parents maintain personal relations or direct contact with children under the age of 16.

When the court is deciding whether, and in what terms, to make a contact order under section 11 the welfare of the child must be the court’s paramount consideration. The court must also – taking into account the child's age and maturity – have regard to any views the child wishes to express and have regard to matters such as the need to protect the child from the risk of abuse.

Those with parental responsibilities and rights (including in relation to contact) are also expected to exercise these in the interests of the child and, where appropriate, to have regard to the views of the child. If the arrangements provided for in a contact order are no longer considered appropriate the matter could, in appropriate cases, be brought back to the court (including by or on behalf of the child themselves) for the order to be varied or recalled.

The court may order contact to take place at a child contact centre. We expect child contact services to take a child-centred approach, using trauma-informed approaches. We would not expect a child who is distressed to be forced into contact.

The Scottish Government provides funding to Relationships Scotland who are the largest provider of child contact services in Scotland. Child contact services have practices in place to help support facilitation of contact orders, for example: familiarisation visits; gradual build-up of time in contact; signals if child wants contact to end; family support workers to support parents and children.

The education and training of the Scottish judiciary is the responsibility of the Lord President, who established the Judicial Institute for Scotland (the Institute) to conduct training for all sheriffs and judges in Scotland.

The Scottish Government’s understanding is that consideration of domestic abuse has been an ongoing component of the Institute’s training since 2019. In response to the Domestic Abuse (Scotland) Act 2018 the Institute launched a learning programme for all judicial office holders at that time. This training included a Domestic Abuse Resource Kit, which has been extended to cover the implications of domestic abuse in civil cases and the interaction between criminal and civil cases.

Domestic abuse training has also been implemented into induction courses since 2019, ensuring that all those coming into post receive similar training, particularly covering the concept of coercive control in the context of domestic abuse. In addition, family and civil law courses consider the impact of coercive control and other forms of abusive behaviour in family disputes.

Solicitors in Scotland have to undertake Continuing Professional Development (CPD) relevant to their roles in line with the Law Society of Scotland's CPD requirements. Training on domestic abuse is available and revisited regularly, for example, the recent webinar on: A Review of Domestic Abuse in Scotland | Law Society of Scotland.

However, there is no specific requirement for solicitors working in the civil system to undergo specialist training in domestic abuse, coercive control and the potential impact on children’s lives.

The Scottish Government regularly discusses a wide range of fire safety topics with the Scottish Fire and Rescue Service (SFRS) including battery energy storage system (BESS) sites.

SFRS is a member of the National Fire Chiefs Council (NFCC) and has access to the wide range of fire and rescue research, guidance and expertise provided by the NFCC. The Scottish Fire and Rescue service provides advice to the Scottish Government on fire safety matters.

There was no communication between the Scottish Government and the NFCC regarding the single recorded incident at a BESS site in Scotland. This incident involved a battery unit which was damaged in transit and was not yet installed. There were no casualties.

The Scottish Government is committed to developing a long-term strategic approach to skills and careers in the culture and creative industries sectors across all roles. In 2020 the Culture Strategy for Scotland was clear that if we are to harness Scotland's creative talents and support a diverse talent pipeline to support the future of the sector, it is important we increase access.

Creative Scotland has a wide programme of work focussed on increasing access to culture and creativity, supporting both those who want to engage with activity as audience members and participants and those who want to work in the sector. An external EDI Advisory Group supports this work, which includes:

• partnering with sector organisations to support accessibility to Creative Scotland funds on a localised/sector/network level;
• clarifying eligible costs for personal and project access in funded projects to remove barriers related to disability/communication difference, caring responsibility, mental health and wellbeing;
• partnership working across the UK Arts Councils to develop the All In access card; and
• addressing key driver of inequality and exclusion through work on health and mental health, including the Participatory Arts and Mental Health Fund.

Creative Scotland also monitors the success rates of those applying to its funds, including those accessing their access support services, and evaluated key development work, such as their 'Create:Inclusion' Fund.

The Scottish Government’s long-standing investment of over £150 million since 2007 in programmes such as the Youth Music Initiative and Sistema has made a huge impact helping young people across Scotland access music-making opportunities and develop their wider skills and learning, encouraging and equipping them to enter the talent pipeline if they wish.

Youth Music Initiative has helped young people in all 32 local authorities access music-making with every pupil offered a year’s free music tuition by the end of primary school. It tackles inequalities by providing music making experiences and wider cultural opportunities to children across Scotland, and particularly to those who otherwise would not be able to participate in these activities. Youth Music Initiative received a 3 per cent uplift in 2025-26, which takes the Scottish Government’s annual investment to £9.78 million. Sistema runs Big Noise education programmes across six communities in Scotland and received a 3 per cent uplift in 2025-26, which takes the Scottish Government’s annual investment to £2.68 million. As part of the Fairer Funding Pilot, the Scottish Government has also committed to fund Youth Music Initiative and Sistema at existing levels in 2026-27, further strengthening their sustainability and the talent pipeline.

In assisting individuals to move on from secondary education and further into the talent pipeline for creative industries, the regular skills assessments in the creative industries from Skills Development Scotland identify the specific skills required for various roles and help organisations and individuals understand areas of expertise and potential gaps. These assessments can be used to inform education and training programs, improve workforce development, and support individual career pathways.

The music talent pipeline is already supported through a very significant offer across Scotland’s Colleges at NC, HNC and HND level covering performance, production, sound engineering, music business and event management. There is also increased specialisation at degree level across Scotland’s Higher Education sector, covering classical, contemporary and traditional music disciplines.

More broadly, Creative Scotland plays a major role in talent development and supporting the creative talent pipeline through the National Lottery funded Open Fund for Individuals which offers early career funding to emerging artists. In 2023-24, the Open Fund made 164 awards totalling £4.2 million for leadership training and professional development.

Through their Targeted Routes and organisations funds, Creative Scotland support organisations and events such as Wide Days, the Scottish Alternative Music Awards, Showcase Scotland at Celtic Connections and Made In Scotland Expo, which provide opportunities and mentoring for young acts. Bursaries such as VACMA and the Stephen Palmer Travel Bursary Fund connected visual artists with peers and development opportunities. Go See Share helps creatives explore and share insights from international creative business models.

In the Screen sector, industry training initiatives supported by Screen Scotland include bursaries for the Edinburgh TV Festival, TRC's SuperSizer, Film FastTrack, and Reset 2023, alongside NFTS Scotland’s paid trainee programme and STV Studios’ Screw training scheme in 2023-24, which supported underrepresented entrants into HETV production.

GMAC Film’s Little Pictures and Short Circuit's Sharp Shorts provide vital support for emerging filmmakers. In 2024, Rising Stars Scotland highlighted new film talent, Screen Fringe fostered collaboration between stage and screen industries, and the YFF Skye Screenwriting Residency offered mentorship to aspiring screenwriters.

Supported by the recent uplift in Grant-in-Aid funding from the Scottish Government delivering the largest budget ever available to Creative Scotland, more than £200 million in support, across a broad spread of creative disciplines, is to be provided to 251 organisations over the next three years. The organisations funded through the Multi-Year fund support individuals in many ways – as employees, commissioned artists, programming of work, audiences and participants.

Organisations like Fèisean nan Gidheal and Fèis Rois create access to music opportunities, Alchemy Film and Arts ‘Film Town’ programme provides a year round programme of community filmmaking, skills development and creative learning, from their base in Hawick. Organisations like Shetland Arts and Eden Court, in Inverness, work with the Education sector to deliver educational courses, alongside other opportunities for artists and participants.

In addition The National Culture Strategy Action Plan updates on work to better understand local authority support for culture and explore future models of collaboration between local and national bodies. Research undertaken by Creative Scotland in partnership with Community Leisure UK and SportScotland was published in August 2024 and will further strengthen Creative Scotland’s efforts to work better together in partnership with local authorities, developing a wider understanding on all aspects that contribute to a healthy cultural ecosystem at the local level. Creative Scotland is now planning their next steps for this work, including a programme of engagement with local authorities.

Creative Scotland’s development work also supports various initiatives across Scotland targeted to the needs of the area. For example:

• Through Targeted (Place Partnership) and Open project National Lottery funding, Creative Scotland continues to support the work of the Creative Arts Business Network (CABN) in the Scottish Borders, which aims is to develop the professional creative sector in the Scottish Borders through a diverse programme of support, including mentoring, showcasing and funding; and
• Culture Collective is a Scottish Government supported programme where organisations, artists and communities work together, providing employment opportunities for creative practitioners and actively engaging people in shaping the future cultural life of their community. The programme initially ran from 2021-2024, and £4 million has been included in the 2025-26 budget to continue the programme.
