The Avian Influenza and Influenza of Avian Origin in Mammals (Scotland) Order 2006 prohibits the release of gamebirds in any Protection, Surveillance or Low Pathogenic Restricted Zones, established around an Infected Premises. This Order also provides Ministers with the powers to prohibit the release of game birds in Temporary Control Zones and Temporary Movement Restriction Zones (where disease is yet to be confirmed) based on a risk assessment of the specific disease situation and premises particulars. When kept there is also a legal requirement to report suspicion of notifiable avian disease in game birds.

The Avian Influenza (H5N1 in Wild Birds) (Scotland) Order 2007 prohibits the release of game birds in a Wild Bird Control Area or a Wild Bird Monitoring Area. Furthermore, Licencing requirements dictate that where Special Protected Area (SPA) or Special Areas of Conservation (SAC) are designated for vulnerable species, consent from NatureScot is required for the release of pheasants. One of the factors considered in this licensing assessment is control of Notifiable Avian Diseases (NADs).

I have asked Teresa Medhurst, Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

Body worn video cameras (BWVC) are currently in place within HMP Kilmarnock and HMP Addiewell.

The feasibility of a pilot to test the introduction of BWVCs across the SPS estate is however being considered in partnership with Trade Union Partners.

Since the publication of the Respiratory Care Action Plan for Scotland (RCAP), the Scottish Government has established the Scottish Respiratory Advisory Committee (SRAC) to oversee its implementation.

Since publication of the Plan, the SRAC identified three initial areas of focus: child to adult transition, pulmonary rehab and respiratory data.

The Child to Adult Transitions subgroup has produced a set of recommendations to ensure children with asthma and other respiratory conditions have the best possible care and treatment as they move into adult service.

We are continuing to focus on improving access to pulmonary rehabilitation. The British Thoracic Society recently published a refreshed quality statement on pulmonary rehab . We are working closely with services across Scotland to identify improvements in delivery and to ensure more people have access.

Public Health Scotland have been commissioned to begin scoping work to develop a respiratory audit programme. This will allow us to monitor the delivery of the RCAP and ensure people are receiving the best possible care, treatment and support for respiratory conditions.

In addition, the Respiratory Specialist Delivery Group (SDG) at the Centre for Sustainability Delivery (CfSD) is progressing significant improvements across a vast range of services, teams, and NHS Boards. This work aligns with the commitments in the RCAP, and we are working closely with the CfSD to ensure that these links continue.

The Scottish Government is working to take forward the action in the Women’s Health Plan that seek to enable all patients to access mid-trimester abortion care locally or regionally. Progress has been made, with all mainland NHS Boards now offering services up to at least 20 weeks’ gestation as recommended by the 2022 Healthcare Improvement Scotland Sexual Health Standards.

The Scottish Government commissioned NHS National Services Scotland (NSS) to develop a specification to deliver a national service for abortions between 20 to 24 weeks gestation within Scotland. NSS has been discussing its specification with NHS Boards and is also exploring other delivery options for the service.

We are also working with individual NHS Boards to support clinicians who wish to receive training to deliver later stage abortions to be granted funding to do so, and to encourage NHS Boards to ensure that patients close to 20 weeks’ gestation are prioritised for appointments.

The Young Patients Family Fund (YPFF) has been available since July 2021. We ask NHS Boards to report on the number of young inpatients (and therefore families) who benefit from the Fund.

I refer the member to the answer to question S6W-16109 on 3 April 2023 in relation to families supported through YPFF in 2021-22.

Since YPFF was established in 2021 NHS Boards reported that 6887 families were supported through YPFF.

As at 9 October 2023, the majority of cells occupied by more than one person across the prison estate had a living space of at least 7m 2.

This information is not held centrally by the Scottish Government. Practitioner Services is the body that pays independent contractor dentists on behalf of the Health Boards.

As set out in our current guidance “Included, Engaged and Involved Part 1: Promoting and Managing School Attendance,” Local Authorities are expected to have robust processes and guidance for children who do not attend school, from the first day they are absent until they are re-engaged with education. I have expressed concerns about the impact of COVID-19 on attendance and in order to inform our policy response, I have asked Education Scotland to undertake work to better understand the current barriers and challenges experienced by schools, children and young people and their families which influence school attendance. I expect to receive the findings of Education Scotland’s work later this year. This work will provide examples of effective strategies that are supporting improved attendance, and clarity on what further support or intervention is required in areas where attendance is not improving.

The findings from our forthcoming Behaviour in Scottish Schools Research, which will be published in November, will also provide important information on the extent to which pupils are disengaging from learning, which we will consider alongside the Education Scotland work.

The COVID-19 pandemic has impacted on all NHS services to an extent, including abortion services.

The Scottish Government is committed to improving access to abortion services and the Women’s Health Plan includes a range of measures which aim to achieve this. Several abortion-related actions within the Women’s Health Plan have been progressed, including:

• making telemedicine consultations a permanent option for patients,
• continuing to allow women under 12 weeks’ gestation to take mifepristone and misoprostol at home where that is clinically appropriate and also now allowing women to take mifepristone at home at later gestations in certain circumstances,
• ensuring patients are offered the progestogen-only pill with their abortion medications, and
• working with stakeholders and Gillian Mackay MSP to introduce the Abortion Services (Safe Access Zones) (Scotland) Bill into the Scottish Parliament.

We anticipate that the long-term action within the Plan to review the provision of abortion services in Scotland will be considered as part of the forthcoming review of abortion law.

Payment reform will be implemented on 1 November 2023. Therefore, it is not possible at this stage to make an assessment on the impact of payment reform on the recruitment of dentists in Dumfries and Galloway and the level of deregistration of adult patients from NHS dental services.

The main purpose of payment reform is to improve access to NHS dental services and thereby reducing the number of deregistrations. This will be done by replacing the existing care and treatment fees with a new set priced at levels that we believe will incentivise dentists to provide a full range of NHS care and treatment.
