This question relates to operational matters that are the responsibility of the Scottish Court and Tribunals Service (SCTS) corporate body. The question has been passed to the Chief Executive of the SCTS who reply in writing within 20 days.

The Scottish Government remains firmly committed to delivering our vision for agriculture and support farming and food production in Scotland to become a global leader in sustainable and regenerative agriculture. To achieve this we are delivering a phased transition from legacy Common Agricultural Policy (CAP) support into the new four-tier framework ensuring ensure a just transition for our farmers and crofters.

In 2025 we introduced additional measures to protect wetlands and peatlands as part of the mandatory conditions of GAEC 6. These measures are designed to promote healthy peatland contributing to improved biodiversity by providing a habitat for plants and insects as well as regulating water flow and prevent flooding.

Work is continuing with the industry as we demonstrate our commitment to co-develop the future support framework delivering the Vision for Agriculture and meeting the objectives of the Agriculture and Rural Communities (Scotland) Act 2025.

The Scottish Government supports local authorities to meet the statutory duties stemming from Part 9 of the Community Empowerment Act (Scotland) 2015 through a range of guidance and collaborative networks, supporting and strengthening local expertise.

In partnership with the Association for Public Service Excellence (APSE), earlier this year the Scottish Government arranged workshops to provide a high-level overview of the legislative requirements of Part 9 and an opportunity for allotment officers to share best practice and network. As a direct consequence of positive feedback received from these workshops, ongoing networking and mutual support will be facilitated when APSE establish a specific allotment and community growing network in the coming weeks.

The Scottish Government has also published detailed guidance to assist local authorities in fulfilling their Part 9 statutory duties:

• Allotments: duty to prepare a food growing strategy – guidance for local authorities
• Allotments: guidance for local authorities – Introduction to Part 9 of the Community Empowerment (Scotland) Act 2015

While the Scottish Government provides support and guidance, decisions regarding allotment provision ultimately rest with individual local authorities. As per the statutory duties under Part 9, they are expected to take reasonable steps to meet their obligations where specific demand for allotments is met.

Since the start of the Baby Box Programme in 2017 up to 22 August 2025, 352,165 Baby Boxes have been delivered to families across Scotland. The Baby Box Managing agent, APS Group (Scotland), have received 190 reports of faulty or damaged items, below is the breakdown of this figure:

The scoring process for applications is based on criteria that do not require information on whether the applications are creating new, expanding or reinvigorating existing growing sites. Since 2021 we have awarded over £491,000 to Green Action Trust, with 55 community organisations and projects across Scotland receiving a share of this funding.

As of 3 September 2025, the Scottish Government no longer has a policy prohibiting the use of public funds to support the manufacture of munitions.

As recommended in the second Strategic Transport Projects Review (STPR2), Transport Scotland continues to work with Strathclyde Partnership for Transport (SPT), Glasgow City Council and other regional partners in the development of Clyde Metro. Transport Scotland is undertaking a project assurance role on the Clyde Metro, which is led by SPT, working alongside Glasgow City Council.

The ongoing stage of development, known as the Case for Investment, includes consideration of access to Glasgow Airport and will inform decisions around network and mode selection. This work is well underway and is currently anticipated to be complete in 2027.

SPT are undertaking on-going engagement with Renfrewshire Council throughout the on-going design development stage and it is anticipated that future engagement will include discussion on the AMIDS South transport links project.

In line with the Employment Rights Act 1996 and the Flexible Working Regulations 2014 employees have a statutory right to make a flexible working request and for that to be considered by their employer. This includes requests to work a compressed hours working pattern.

The Scottish Government’s Flexible Working policy allows staff to request informal or formal compressed hours where this form of flexible working is suitable for the post and the needs of the Directorate. Such arrangements are based on fulfilling the Scottish Government’s contracted full time working hours of 35 hours per week in whatever working pattern is agreed (e.g. four days per week, nine day fortnight etc).

Compressed hours requests are made and considered at an individual employee level and are not applied as a singular working pattern at a directorate or organisational level where the standard full time working week continues to be five days. In considering individual requests for a compressed hours working pattern from an employee, managers are required to ensure that adequate cover remains in place within their team across the full working week. Where that would not be the case, such requests may be rejected.

Regarding the four-day working week, a pilot was undertaken by two public bodies (Accountant in Bankruptcy and South of Scotland Enterprise) as part of the 2023-24 Programme for Government where staff piloted working a 32 hour week. This pilot will end on 3 November.

The SG and its agencies will not be moving to a 32 hour week however the findings from the pilot will be shared with the Scottish Government and wider public sector to support ongoing public service reform efforts.

I have asked Teresa Medhurst, Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

SPS has a zero-tolerance approach to violence towards staff and has support mechanisms in place to assist prison officers who have been affected by it. Incidents of criminality are reported to Police Scotland and SPS will actively seek prosecution.

Following the successful pilot of Body Worn Video Cameras at 3 prison sites, cameras are to be rolled out across the prison estate which will include HMP Greenock.

The cameras will complement an already well established range of staff training, security systems and clear operating procedures used to promote and support safety for everyone working and living in prisons.

Given the short amount of time left in this Parliamentary session, there is insufficient time for a Misogyny Bill to be finalised and introduced. This is a complex area of policy and law, and it would be necessary that any Bill which brought misogyny into criminal law contained clear and unambiguous provisions in regard to the circumstances in which they apply. This would include the policy implications of the recent Supreme Court judgment.

We want new legal protections for women and girls to be in place, and the hate crime model presents an opportunity to do so. On Thursday, 28 August 2025, we laid in draft an SSI to add the characteristic of sex to the Hate Crime and Public Order (Scotland) Act 2021. If passed, it will make it an offence for a person to stir up hatred against women and girls, and where an offender is motivated by, or demonstrates, malice and ill-will towards women and girls in committing a criminal offence, that offence will be aggravated by prejudice relating to the characteristic of sex.

Further, we continue to take forward a range of actions in schools to address gender based violence and sexual harassment. Our Mentors in Violence Prevention (MVP) Scotland Programme is working to tackle gender stereotyping and attitudes that condone violence against women and girls, and addresses a range of behaviours including name-calling, sexting, controlling behaviour and harassment. We have also published a national framework for schools to help tackle sexual harassment and gender-based violence. Rape Crisis Scotland also provide a national sexual violence prevention programme to local authority secondary schools across Scotland. The programme aims to provide consistency in approaches to the prevention of sexual violence and contributes to Equally Safe (our strategy to prevent and eradicate violence against women and girls). Since the programme started in 2016, it has reached over 48,000 pupils.
