Within its maintenance contracts, Transport Scotland have defined contractual restrictions on the times maintenance works can be carried out, to minimum disruption and other impacts on road users, communities and business. For example, typically road works are normally not permitted during the following hours:

• Monday to Friday:- 06:00 to 09:30, and 15:30 to 20:00.

• Saturdays:- 07:00 to 20:00.

• And over the period from 1 December to 15 January:- 06:00 to 22:00

In some cases, particularly on our busy motorway networks, night time working is preferred as it reduces disruption but also helps maintain the safety of road users and construction workers. There may also be occasions, for example during an emergency response or where a maintenance activity is prolonged, when night time working cannot be avoided.

Where possible Transport Scotland’s Operating Companies will endeavour to avoid night time working near residential areas. Where this is not possible our Operating Companies are required to i) engage with affected residents and stakeholders through advanced consultation ii) act responsibly and reduce work noise as much as possible, through noise management plans and iii) treat any complaints fairly and expeditiously.

Today I am announcing the establishment of the independent ‘Facilitating Peaceful Assemblies in Scotland: Procedures and Best Practices – Short Life Working Group’ which brings together a small number of experts with backgrounds in marches, human rights, community engagement and mediation/dialogue.

The working group will consider what can be learned from other models used in relation to the regulation of marches and parades including, but not limited to the Parades Commission in Northern Ireland, and consider whether any of this learning can be usefully adapted and applied in Scotland to improve the regulation of marches and parades.

The remit for the working group is:

To identify any challenges that are involved in the running of marches and parades and the notification process in Scotland to achieve the right balance between the human rights of organisers/participants with those communities impacted by these events. To consider how these challenges could be addressed, and the practical implications of making any changes, and make recommendations based on these .

The members of the working group are:

• Professor Dominic Bryan, (Chair) Professor at the School of History, Anthropology, Philosophy and Politics, Queens University Belfast;
• Lorraine Gillies, Chief Executive Scottish Community Safety Network;
• Graham Boyack, Director of Scottish Mediation;
• Dr Michael Hamilton, Associate Professor in Public Protest Law, School of Law, University of East Anglia.

The working group will provide their initial report to me by summer and I will update the Scottish Parliament on any actions I propose to take in response to this report.

We are keen for Tighean Innse Gall to continue to help deliver insulation improvements as part of our Area Based Schemes. We’re also keen for them to retain their status as an approved installer of insulation with the British Board of Agreement.

Scottish Government officials and officers from the local council have been working with Tighean Innse Gall to find practical solutions to the specific issues in the Western Isles. The Scottish Government will shortly be writing to confirm the actions that have been agreed with the Comhairle nan Eilean Siar.

These are issues we have raised with the BSI, including the particular challenges of improving the insulation and ventilation of traditionally constructed homes in the Western Isles. We are pleased that the BSI has agreed with us that a greater input from Scottish stakeholders with local experience and knowledge is key to delivering meaningful standards. This will include technical experts from our remote rural and island communities in future.

The PAS2035 and PAS2030 standards for retrofit and installation of energy efficiency measures are published by the British Standards Institution (BSI). Installers of insulation measures must comply with PAS2030:2019 to retain their approved status as part of recognised industry schemes.

We agree that changes to the PAS2030 and PAS2035 standards are needed if they are to better reflect the housing stock, weather and environmental conditions in Scotland. However these are UK standards and the BSI are sponsored by the UK Government.

The Roads (Scotland) Act 1984 places the statutory responsibility for local roads improvement, maintenance and repair with local road authorities.

The vast majority of funding to local authorities from the Scottish Government is provided via a block grant and we do not stipulate how local authorities should utilise their individual allocations. It is therefore the responsibility of each local authority to manage their own budget and to allocate the financial resources available to them on the basis of local needs and priorities, having first fulfilled their statutory obligations and the jointly agreed set of national and local priorities.

However, the Scottish Local Government Finance Statistics (SLGFS) provides an overview of actual spend based on Local Authority’s audited accounts which may be useful.

The average public sector spending on transport in Scotland is estimated to have been £682 per person in 2019-20 compared to £487 in England and £398 in Wales. This is based on HM Treasury Public Expenditure Statistical Analysis 2021 and ONS Mid-Year Population Estimates for 2020.

In terms of personal spending on transport, average weekly household expenditure in Scotland on transport and vehicles in 2018-20 was £75.30. This compares to £84.00 in England and £78.10 in Wales. This is based on ONS data on household expenditure by country and region.

Despite the promised £290 million from the UK Government not turning out to be net additional funding, given the offsetting reductions they applied to their prior funding estimates, the Scottish Government during the Budget Bill Stage 3 debate on 10 February, detailed additional support worth around £290 million for our cost of living response. £150 is being provided to everyone in receipt of Council Tax Reduction, and to everyone in council tax bands A to D, as well as certain households exempt from council tax. This is worth around £280 million, plus £10 million to continue our Fuel Insecurity Fund.
