The Scottish Government currently has no plans to legislate on the model adopted by land-owning land maintenance companies.

We are however, currently working on a non-statutory voluntary Code of Practice in relation to the dismissal and replacement of land-owning land maintenance companies. The Code would introduce guidance on the minimum standards expected from any land-owning land maintenance company following a request from homeowners formally requesting to dismiss and replace them. This would include information that such companies should provide to homeowners, following the transfer of the ownership of the land, and future arrangements for maintaining the land.

The Property Factors (Scotland) Act 2011 sets minimum standards for the property management industry (including land maintenance companies). It provides protections for homeowners who use their services. The Act requires all factors to be on a national register and abide by a statutory Code of Conduct.

Homeowners who have complaints about the level of the service of their property factors can apply to the First-Tier Tribunal for Scotland (Housing and Property Chamber) for redress. Further information at: https://www.mygov.scot/property-factors/ .

If no property factor as defined in section 2(1) of the 2011 Act is appointed to maintain greenspace when it moves into private ownership, then homeowners should make contact with the owner of the land to establish the obligations that were agreed at hand over or sale of the greenspace. Enforcement may be required by the local authority or through the court. Homeowners may also wish to consult their title deeds and may wish to seek independent legal advice from an advice agency or solicitor.

The Scottish Government will be providing a £150 cost of living award to all households in council tax bands A to D, including those who are not receiving a reduction under the Council Tax Reduction scheme. Local authorities will also be provided with funds from which to make £150 payments to certain categories of low income households which are exempt from council tax, including those accessing housing support services or living in temporary accommodation. In addition, we are providing an extra £10m to continue our Fuel Insecurity Fund to help households at risk of self-disconnection, or self-rationing energy use.

The Improvement Service (IS), who manage the application process, do not have the statistics on applications started available. Some online applications were submitted in advance of the 10 January 2022 application open date. At close of business on 1 March 2022, there had been a total of 201,306 online applications submitted.

The IS are able to report on the online rejection numbers only. At close of business on 1 March 2022, 47,251 applications had been rejected. Among the most common reasons for rejection were:

? Abbreviated birth certificate supplied which contains insufficient information necessary to prove that a parent is authorised to act on behalf of a child.

? Documents supplied cannot be read

? Parental ID not supplied

? Mismatch on address

? Data mismatch

? Non-compliant photo

? Documents do not pass security features checks

? Wrong date of birth

? Duplicate application

? Failed ID verification checks

The Scottish Government published Coronavirus (COVID-19): face covering and masks guidance which provides information on the requirement to wear face coverings (unless exempt) including enforcement measures.

Enforcement of COVID-19 restrictions is a matter for Police Scotland and any breaches of these regulations can be reported to Police Scotland directly.

The police have enforcement powers to issue a Fixed Penalty Notice of £60 (halving to £30 if paid within 28 days) if members of the public do not comply with this law without a reasonable excuse. Officers have been asked to Engage, Explain, and Encourage with Enforcement only as a last resort.

We continue to keep the regulations and guidance under regular review.

Universities and colleges have a duty of care to support their students, and if any have experienced difficulty or have concerns about studying remotely they should contact their institution as soon as possible in order to access the support they need.

We are aware of the impact of the pandemic on student mental health and wellbeing, and have continued to address this, through that period, by providing additional funding to help students deal with the mental health impacts of the COVID-19 pandemic, support to NUS Scotland and student associations for vital welfare support for students in colleges and universities and additional funding for colleges to help students and staff respond to the pandemic.

The Scottish Government is committed to the development of a research and evidence informed Student Mental Health Action Plan and we are re-establishing the Student Mental Health and Well Being Working Group to help take this forward.

In 2006 the Scottish Government transposed the European Union's Environmental Noise Directive (END) for managing noise pollution into Scots law via the Environmental Noise (Scotland) Regulations 2006. European countries follow a generally consistent approach to noise mapping and action planning, for example the prioritisation process developed for Scotland’s noise action plans is based on a prioritisation process which aligns closely with the Dutch Road Noise Mitigation Programme.

In preparation for the next round of noise mapping, and to ensure noise mitigation best practice and associated legislation is fully considered, the Scottish Government has convened the Scottish Environmental Noise Steering Group (SENSG). This includes representation from key stakeholders and provides a forum to steer the production of Scotland’s strategic noise maps and associated Action Plans, including the prioritisation of control measures such as any that may be required on the trunk road network.

Throughout the pandemic, the Scottish Government has worked in collaboration with the college and university sectors to provide support and guidance, and to ensure the safety of staff and students. Following the publication of the Scottish Government’s updated Strategic Framework on 22 February, we are working with partners on the Advanced Learning COVID-19 Recovery Group to develop a framework to replace prescriptive sector-specific guidance.

This framework will provide high-level guiding principles and support for institutions in developing local solutions. We will also work with universities and colleges to support the development of institution-level COVID-19 Response Committees. The committees – using existing structures where possible with representatives from the institution, trade unions, students and accommodation providers – will monitor the public health and wider context, with a view to adjusting local safety protocols accordingly. This will enable decisions on COVID-safety measures, beyond any that may be in place across society, to be determined locally and, where possible, collectively.

I have asked Teresa Medhurst, Interim Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

SPS is currently in the process of selecting a contractor to initially develop a design for HMP Glasgow and thereafter award a contract for the construction of the new prison.

It is anticipated that a contractor will be appointed later this year to develop the design stage of the project.

On 26th January the Scottish Government published its draft vision for Scotland’s future public electric vehicle charging network and announced its plans for a new £60m public electric vehicle infrastructure funding programme. This recognises that to grow Scotland’s public charging network we will need to attract commercial investment which can potentially secure significant opportunities to anchor well-paid, high-quality jobs across Scotland.

The vision acknowledges that the public sector will have a critical role in attracting investment in public electric vehicle charging infrastructure through partnership working with the private sector. Local authorities will continue to plan outcomes for local areas including development of public charge point strategies and community engagement around these. This new approach to growing Scotland’s public electric vehicle charging network potentially enables a variety of charge point ownership and operator models, which could include community initiatives, particularly in rural areas. There is also potential to deliver community wealth building opportunities through local public procurement exercises and targeting socially inclusive investment to support local jobs.
