The presumption against short sentences was extended from 3 months or less to 12 months or less in July 2019. While relevant sentencing data is being monitored, the impact of COVID-19 on court business means it is not possible to confidently identify and attribute cause to any trends in court disposals in the period monitored to date. Caution is also required generally in attributing changes in sentencing patterns to any particular factor.

A bulletin ‘Extended presumption against short sentences: monitoring information - January - December 2020’ was published on 23 March 2021 and is available at www.gov.scot . In addition, the latest criminal proceedings bulletin presents data for the financial year 2019-2020, which includes 9 months of sentencing data after the extension.

While there is no estimate in the reduction of people receiving custodial sentences as a result of the presumption, the criminal proceedings statistics show that between 2018-19 and 2019-20, there was a 13 percent reduction in the number of custodial sentences of 12 months or less from 9,585 to 8,324. The number of custodial sentence of “up to 3 months” decreased by 19% from 3,139 in 2018-19 to 2,551 in 2019-20, and is less than half the number ten years ago.

There is a range of action supported by the Scottish Government to deal with insidious behaviour amounting to online bullying and harassment.

Ensuring the criminal law can deal effectively with conduct amounting to threatening or abusive behaviour led to the Scottish Government introducing the offence at section 38 of the Criminal Justice and Licensing (Scotland) Act 2010. Such behaviour can often arise online and amount to bullying or harassing type behaviour. This offence is capable of dealing with this type of conduct depending on the specific facts and circumstances.

Where bullying and harassment occurs online affecting children and young people, this can be especially harmful. The Scottish Government's 'Respect for All - national approach to anti-bullying' was published in 2017 and is focused on building capacity, resilience and skills in children and young people to prevent and deal with bullying including online.

Regulation of the internet is a reserved area. The UK Government on 17 March 2022 introduced their Online Safety Bill into the UK Parliament. The Scottish Government is committed to work with the UK Government where devolved areas arise relevant to the policy of the Bill.

The health and wellbeing of everyone in Scotland, including those who are immunosuppressed or immuno-compromised, is paramount as we transition out of the Covid-19 pandemic.

Following the success of the initial vaccination programme, the Scottish Government recently announced that a spring booster dose will be offered to everyone aged 12 and over who is immunosuppressed, in line with the JCVI recommendations.

Immunosuppressed individuals are also eligible for new treatments to minimise the impact of Covid-19, should they contract it, and have priority access to testing to ensure they receive these as quickly as possible. We will continue to respond to scientific and clinical advice regarding COVID treatments, making sure that those who we know will benefit most from them are able to access them.

We will continue to provide advice and information for people on the Highest Risk List in the meantime, including how to get help to re-connect with people and things they were doing before the pandemic, and we will continue to look at ways to identify people who may be at higher risk and ask them to follow the individualised advice from their GP or clinician who knows their circumstances and health condition best.

I welcome Audit Scotland’s review into drug and alcohol services and their recommendations. We agree that more can be done to improve the accessibility and transparency of funding and how it is used.

Currently information on funding allocation is available through various publications including published budgets and I also report to Parliament regularly outlining our progress and funding decisions. We have also recently agreed on eight recommendations with COSLA to implement the Partnership Delivery Framework which underpins the governance of Alcohol and Drug Partnerships, this includes a recommendation requiring Health and Social Care Partnership Chief Finance Officers to be represented at the ADP and provide assurance regarding funding for alcohol and drug services including clear financial reporting. In addition, Public Health Scotland have been tasked with introducing new monitoring to track both the number of and investment in residential rehab placements by ADPs.

Recruitment and retention of voluntary and retained on-call firefighters is an operational matter for the Scottish Fire and Rescue Service.

A final decision on the number of hubs has not yet been taken. A paper to the Restorative Justice Stakeholder Group, published on the Scottish Government website in 2021, set out a proposal to develop up to 6 administrative restorative justice hubs based on sheriffdom areas, and discussion is underway with our stakeholders and partners on this. The precise number of regional hubs in place by 2023 will be subject to these discussions and a range of factors such as level of demand, and cannot be confirmed at this stage.

Modelling work completed prior to omicron suggested it would be March 2023 before all screening centres in Scotland would reach the point of being able to offer breast screening rounds of 39 months. There are however a number of factors at play including the ongoing pandemic, the steps we are continuing to take to increase capacity in the screening programme, as well as options that are being considered to accelerate the recommencement of self-referrals for women over-70.

The Improvement Service (IS), which manages the application process, has confirmed that at close of business on 15 March 2022 there had been a total of 226,484 online applications submitted.

Because the offline application process is undertaken by local authorities using multiple routes, including schools, libraries and council offices, there are practical challenges currently to providing an accurate national picture of offline applications. However, it is possible to provide details of how many applications in both settings have been processed.

By close of business on Tuesday 15 March 2022, IS confirmed that a total of 187,345 National Entitlement Cards with free bus travel had been produced and dispatched. This total includes cards generated from both online and offline applications.

In addition, by the end of 14 March 2022, 4,696 travel products have been added to existing National Entitlement Cards through the Transport Scot Collect App which was launched on 28 February 2022.
