I refer the member to the answer to question S6W-09365 on 7 July 2022. Information on the number of complaints regarding the use of restraint in schools and care settings is not collected at a national level by the Scottish Government. Under existing guidance, any use of physical intervention in schools, including restraint, must be recorded and monitored by local authorities. This is in addition to the inspection roles of carried out by Education Scotland.

The Scottish Government encourages all concerns or disagreements in relation to service provision to be resolved at as local a level as possible, where that is appropriate. Complaints can also be submitted in line with the service’s complaints handling procedure, with referrals made to the local authority and public services ombudsman, where appropriate. Where there are concerns about the professional conduct of a teacher registered with the GTCS, these can be referred to the GTCS for further examination. All children and young people, and their families, should be informed of all the routes available to them to make a complaint.

In all settings, police or social work should be informed without delay if there are concerns that a child or young person has suffered harm as a result of restraint. A child protection referral can run in parallel to local complaints handling and disciplinary procedures. Child protection procedures will be initiated when police, social work or health determine that a child may have been significantly harmed or may be at risk of significant harm.

Work on the precise methodology, design and evaluation for the peak rail fares pilot is currently underway. Transport Scotland officials are working closely with Scottish Rail Holdings and ScotRail Trains Ltd to derive maximum benefit for this scheme.

Further details on the peak rail fares pilot including timescales during the next financial year will be confirmed as soon as practically possible.

The works at each of the ports as part of the Skye Triangle Infrastructure programme (Tarbert, Lochmaddy & Uig) are aimed at replacing life expired infrastructure, improving resilience and increasing the range of vessels that can use the ports. The Lochmaddy project is estimated to cost £21million. Our response to the Freedom of Information Request 2022-00297832 published in July 2022 outlined that we have offered a capital funding contribution of up to £15,747million with the remaining contribution to be met by the Comhairle nan Eilean Siar (CNES) as statutory harbour authority.

Data around the number of people taking up interim care placements procured using the additional funding offer announced in January 2023 is published weekly on a Thursday at Interim care placement uptake - gov.scot (www.gov.scot) .

The data is currently not available broken down by NHS board.

This Government is clear that industrial action in our schools is in no one’s interest, least of all for pupils, parents and carers who have already faced significant disruption over the past three years.

As indicated by the Office of National Statistics, it is concerning that this industrial action is putting parents and carers are at further financial loss.

We are absolutely committed to reaching teachers’ pay deal and are working closely with the teaching unions and local government partners to reach a resolution as soon as possible. We also continue to urge the teaching unions to suspend industrial action while these talks are ongoing.

Public Health Scotland publishes quarterly statistics relating to the number of waiting list removals, by specialty and health board of treatment. These data include all waiting list removals under reasons such as ‘transferred’ and ‘referred back to GP’. The latest statistics are published up to 30 September 2022, and for inpatients and day cases can be found using the link below, under Table 2.4:

Public Health Scotland publishes monthly statistics relating to the number of cancelled planned operations at health board and hospital level, a summary of which is available the following link:

The latest statistics published cover the period up to 31 December 2022 and the number of planned operations that were cancelled by patients each month from May 2021 onwards can be found within the tab ‘Publication table’ in the link below:

These statistics are sourced from local theatre systems and only includes cancellations that were cancelled the day before, or on the day the patient was due to be treated. PHS does not collect information on cancellations that occur prior to this.

In response to part c)

Please note that Public Health Scotland does not hold any information on patients who have declined a procedure.

The PAS 2030 standard is a requirement for Warmer Homes Scotland (WHS). Warmworks, the managing agent for WHS, are responsible for ensuring their staff and sub-contractors are adequately trained. However, the Scottish Government also has a Quality Assurance and Audit (QAA) contract for WHS. This contract is managed by Pennington Choices who carry out audits on Warmworks sub-contractors to make sure that they have the appropriate accreditations.

WHS is due to end in 2023, and procurement is currently underway for a successor. The successor will adopt PAS 2035 standards. As the contract has not yet been awarded, the details of how this will be achieved are not yet available. A new QAA contract will also be procured for the successor.

The capacity and capabilities of the retrofit supply chain in Scotland are generally sufficient to meet the needs of our Area Based Schemes (ABS). Local councils have access to a framework of specialist contractors through Scotland Excel. Often these contractors have been PAS compliant for many years with longstanding training and apprenticeship programmes.

Inevitably some ABS individual projects are delayed due to a wide range of factors. The Scottish Government is working with councils and the supply chain to increase local delivery capacity and expand existing capabilities. This will help to reduce the risk and impact of unexpected project delays.
