As outlined in the Policy Memorandum accessible for the Land Reform (Scotland) Bill, landowners will be entitled to apply to the Scottish Ministers for compensation for any loss or expense that is incurred in complying with procedural requirements, attributable to a potential transfer being prevented, or attributable to a lotting decision (including the requirement that lots be transferred to different purchasers). The amount of compensation will be determined by Scottish Ministers, or by the Lands Tribunal on an appeal against the Ministerial determination.

The Scottish Government is committed to the safe assessment of and remediation of buildings identified as at risk through the cladding remediation programme. However, it is important to clarify that fire safety remains the legal responsibility of the owner.

The Cladding Remediation Programme is being delivered through a distributed model, supporting owners to arrange Single Building Assessments (SBAs) to determine the scope and nature of risk for individual buildings.

Where remediation is required following an SBA, building owners are supported to develop appropriate design and remediation plans. However, the pace of delivery is influenced by a range of factors, including the specific outcome of each SBA, the complexity of the remediation that may be required, ownership and tenure arrangements, the involvement of original developers, and the need to obtain statutory consents such as planning permission and building warrants.

In the meantime, all buildings should have fire safety measures in place, such as up-to-date fire risk assessments and interim mitigation measures where needed. Building owners and managers are expected to take all necessary steps to ensure the safety of residents in accordance with their legal duties.

For these reasons, it is not currently possible to publish a national timeline for the completion of all necessary remedial works. The Scottish Government continues to work closely with delivery partners to progress buildings through each stage of the programme, and we publish regular updates on our website. Homeowners and residents are kept informed throughout this process, and every effort is being made to expedite the safe remediation of affected properties.

The following table provides a breakdown of homes delivered through the demand-led Rural and Islands Housing Fund, by financial year, between 1 April 2016 and end March 2025.

The Parliament email system receives approximately 700,000 email messages sent to Members every month, and like every modern organisation, the Parliament utilises automated tools to identify and manage unsolicited email messages including ransomware, phishing and spam emails. 

With the automated tools we use we have a high degree of confidence that the email messages identified are spam emails or contain harmful content such as viruses or ransomware. These messages will then be blocked automatically and not delivered to Members mailboxes.  Messages automatically identified as spam email, but with a lower level of confidence are delivered to the quarantine area where they can be viewed and released if appropriate.

The SPCB recognises that releasing quarantined email is challenging for their staff who have delegate access to a Members mailbox due to the way our email system works.  We have raised our concerns with the supplier and our officials are investigating ways of best managing the issue.

The Scottish Government undertook a range of consultation to develop the proposals in the Bill. Engagement with landowners and wider stakeholders is set out in the Land Reform (Scotland) Bill - Business and Regulatory Impact Assessment and the results of our public consultation is set out in our 5. As part of further development during Stage 1, consultation was undertaken with a range of stakeholders including the following bodies:

• UK Infrastructure Bank (now National Wealth Fund)
• Scottish National Investment Bank
• Scottish Futures Trust

This engagement highlighted the importance of clarity for both landowners and lenders on the timescales and decision process for the transfer test provisions in the Bill. Amendments have now been agreed by the Net Zero, Energy and Transport Committee at Stage 2 which will introduce timescales for Ministerial transfer test decisions and place a duty on Ministers to publish guidance on the process.

The Scottish Government expects employers to meet their legal obligations regarding employment costs arising from statutory duties to workers, including in relation to parental leave, sick leave and redundancy. As part of our Fair Work approach, we also encourage employers to adopt practices which foster inclusive, equitable, and sustainable workplaces. I refer the member to the answer to question S6W-38593 on 24 June 2025 regarding employment costs in grant agreements.

A lotting decision only takes place in a situation where a landowner is voluntarily selling their land. The lotting provisions cannot be used to compel an owner to sell land where there is no intention to dispose of it in the first place, nor sell a particular business or employer entity. If Ministers decide to order lotting, they must specify the lots, and the lots must then be transferred to different purchasers. All aspects of each sale would otherwise be determined between the seller and the prospective buyer.

In the event that a transfer of a particular lot specified by Ministers amounted to or formed part of a transfer of an undertaking, it would accordingly be for the parties to the transaction to determine the relevance of the Transfer of Undertakings (Protection of Employment) Regulations 2006.

Scottish Government Officials and Ministers engage with a wide range of stakeholders to inform policy. This engagement has informed the production of the Building a new Scotland series (BANS). We are not aware of any representations from foreign investors expressing concerns about access to the UK Market in an independent Scotland.

The Scottish Government is committed to working with like-minded investors to increase investment in Scotland. EY's latest Annual Attractiveness Survey showed that Scotland has maintained its position as the top performing Foreign Direct Investment (FDI) region or nation of the UK outside of London for the past 10 years and is ranked sixth among the top ten FDI locations in Europe.

With the full powers of independence, it would be possible to further strengthen our approach to attracting investment. The full range of fiscal and regulatory powers and incentive mechanisms could be aligned to match our policy ambitions and values.

The following table provides a breakdown of funding allocated to the demand-led Rural and Islands Housing Fund (RIHF), and expenditure, by financial year, between April 2016 and end March 2025.

A total of £14.358 million has been spent through the Rural Housing Fund, and £15.876 million through the Islands Housing Fund.
