Why would animal welfare not be in the bill, given that the bill outlines what we want to achieve? Why would secondary legislation be a better place for it? If we know what the animal welfare concerns are just now, why do we need to wait until secondary legislation, which we do not have the same ability to scrutinise as we do primary legislation?

With regard to the parliamentary process, should the code of practice be scrutinised by the committee before it is activated?

Well, not necessarily. The question is whether the committee has a role in scrutinising the code of practice and future farm plans. There is a suggestion that the Government has to bring forward a plan on which it will consult, but there is nothing in the bill that suggests that this committee, or the Parliament, has any role in that regard. Are you suggesting that there should be an obligation in the text of the bill for the code of practice, or for a future plan, to come before the Parliament?

It absolutely does.
That leads us on to how the code of practice is to be measured, monitored and evaluated, which is currently unclear on the face of the bill. There needs to be provision in the primary legislation to ensure that monitoring and evaluation are covered in the secondary legislation.
