The Committee agreed to take items 5, 6, 7 and 8 in private.


2 Instruments subject to affirmative procedure:

The Committee agreed that no points arose on the following— 

First-tier Tribunal for Scotland Local Taxation Chamber and Upper Tribunal for Scotland (Composition) Regulations 2023 (SSI 2022/Draft)
Upper Tribunal for Scotland (Transfer of Valuation for Rating Appeal Functions of the Lands Tribunal for Scotland) Regulations 2023 (SSI 2022/Draft)

3 Instruments subject to negative procedure:

The Committee agreed that no points arose on the following—

4 Instruments not subject to any parliamentary procedure:

The Committee agreed that no points arose on the following—

Valuation Roll and Valuation Notice (Scotland) Order 2022 (SSI 2022/370)


5 Trusts and Succession (Scotland) Bill (in private):

The Committee considered and agreed its approach to the scrutiny of the Bill at Stage 1.


6 Bail and Release from Custody (Scotland) Bill (in private):

The Committee considered the Scottish Government's response to points raised on the delegated powers provisions in the Bill at Stage 1 and agreed to report to the lead Committee on the Bill, the Criminal Justice Committee.


7 Public Order Bill (UK Parliament legislation) (in private):

The Committee considered the delegated powers conferred on the Chief Constable of the British Transport Police (with consent of the Scottish Ministers) and UK Ministers  in the Public Order Bill (UK Parliament legislation). The Committee agreed to report to the lead Committee on the Bill, the Criminal Justice Committee.


8 Retained EU Law (Revocation and Reform) Bill (UK Parliament legislation) (in private):

The Committee considered the evidence it received at last week's meeting. It also considered the responses received from the Scottish Government and the UK Government on the powers to make subordinate legislation within devolved competence in the Retained EU Law (Revocation and Reform) Bill (UK Parliament legislation). The Committee agreed to consider the Bill again at its next meeting.
