That the Parliament notes the decision of the South Lanarkshire Council Planning Committee to reject the application for an incinerator at Whitehill in Hamilton; congratulates all the community groups involved in campaigning against the proposal, including Hamilton Energy Recovery Action Group, Bothwell Community Council, Whitehill Neighbourhood Management Board, Blantyre Community Council, Uddingston Community Council, Cambuslang Community Council and Halfway Community Council; acknowledges that this is the second time that an application for an incinerator at the proposed site on Whistleberry Road has been rejected by South Lanarkshire Council, after the initial rejection in 2013 was overturned on appeal by the Scottish Government; calls on the developer to recognise the wishes of the local community and accept this rejection as final; believes that the campaign against the incinerator at Whitehill exemplifies the imbalance of power between communities and developers in the planning process; agrees that communities should be given a stronger voice in the planning process, and that the appeals system must be rebalanced to equalise the balance of power between communities and developers; considers that the Planning (Scotland) Bill in its current form does nothing to address this imbalance of power between developers and communities, and accepts calls to amend the Bill to reform the appeals system and curb the rights of developers to make repeat applications until they get the decision that they want.
